He's a constitutional lawyer, that's the only requirement to be on the Supreme Court.

He has a degree from Harvard Law and served as a civil rights attorney. He should have been a judge first but that's a different thing.

Yes, completely legal....in fact it's already been done - President Taft was a Supreme Court justice after his presidency

No. He would probably make a fairly good justice, despite lack of experience (generally I want them to have been judges at some level before), but I just don't like the precedent. The next president would expect the same.

Taft however WAS a judge before becoming President. For eight years on the Sixth Circuit Court of Appeals, from which he could conceivably have been promoted to Supreme Court justice even if he'd never been President.

There are no requirements for becoming a Supreme Court justice. The president could appoint a one month old Frenchmen as a Supreme Court justice if he felt like it. That wouldn't happen for many reasons, but there are not prerequisites against it.

It's not the same precedent. Taft as I said was a judge before and could have been a SC justice without ever having been President first.

But anyway, if I'd been alive back then I'd have said the same thing about Taft. No matter how good he might be, let's not appoint him to the SC, because it MIGHT establish a precedent. For less qualified (but presumably popular) Presidents thereafter.

Public officials are held to a much lower standard today - I seriously doubt today's public would differentiate Taft's prior service in the bench. Most Americans today couldn't identify him as a past president let alone a prior member of the supreme court
