By being president, he puts himself in a position of either having to recuse himself or separate himself from every case that has to do with his very openly declared positions, or his previously passed laws. That does not a good justice make.

Moreover, he was a senior lecturer, as pointed out. He was not a judge. Not any lawyer can serve as a judge, even a lawyer that focuses in constitutional law. Familiarity working within the system as a legal expert, and not as a politician, is necessary. The ideal candidate is either a federal prosecutor who has decades and decades of experience working with the Justice Department, or a judge who has worked their way up the court system. Not a controversial politician who cannot be expected to maintain an impartial attitude.

Well he really doesn't have a lot of experience in the legal field, I'll give you that. I would suspect that the main reason that they would nominate him would be to piss off all right wing.

Elena Kagen? Who had years of experience as a federal prosecutor, working intimately within the federal justice department and who served as the Dean of Harvard Law? Obama doesn't have nearly the background that Kagen has when looking at experience with federal judicial process. He is a politician, which is a fundamentally different job than a federal prosecutor, and which requires very different skills than a judge requires.

Ok. He's not going to get appointed. I suspect it's a bunch of Obama fanatics. Not to piss off the right wing. and even if it was, that's fucked up. Sacrifice the prestige of the Court to do that? Let's not.

Sorry his goals, and beliefs are too well known. To get past the Senate you need to be able to tell them you are a great legal mind who has never though about the issues of our day.

If he's replacing Scalia then yes. I don't care who replaces Scalia so long as someone does. Hitler for US Supreme Court if it means getting rid of Scalia.

I couldn't care less. I'd rather him not be in the supreme court, seeing as he is a mediocre president who's almost inevitably going to retire after 2017.

If hes appointed to the supreme court, well, fine, it's not going to ruin my morning.

He's an Originalist who staunchly opposes the judicial activism the Court and the Left are very fond of these days. He's branded a conservative, but generally his position is more about stopping the Court from making laws and protecting the integrity of the Constitution. \

I don't frequently agree with him, but people like him are a necessary part of the system.
