Militia Cleanup: Did you say take away their kids?

REMINDER: Do not gloat, advocate death, advocate other criminal activities, etc.



The Occupation of Malheur has ended with no further bloodshed. We now move into the process of cleanup and legal battles.


Recent news:
In his first time in court, Cliven requested a court-appointed attorney. The Judge has refused to do so until he can provide financial paperwork proving he cannot afford one, stating "
"The court only appoints counsel for those who can't afford an attorney." :lol2: Seems to me, with the million he owes in back payments, he should have plenty of change lying around.


Nine additional indictments have been released. Seven are public, and two additional names on the list have been censored. At least two are already in custody. The charges are the same as those that the prior group was initially indicted on, but while those folks are likely to face increasing charges as the FBI and others investigate the refuge (see below), these folks are likely to stick closer to just this initial charge - carrying a maximum sentence of six years. That brings us up to....23 indictments, if I'm counting correctly.


Here's the transcript of the FBI's news conference.

This morning the FBI took into custody the four remaining occupiers at the Malheur National Wildlife Refuge without incident and without shots fired. Rev. Franklin Graham and Michele Fiore were at the checkpoint to meet the occupiers as they left their encampment.

As we have said since day one, our goal has been to end this illegal occupation peacefully, and we are grateful that we were able to do so today. I want to make it very clear that we will continue to enforce the law with respect to the refuge and other federal properties. Anyone who chooses to travel to Oregon with the intent of engaging in illegal activity will be arrested. Saying that, I want to reassure those Harney County residents who simply visited the refuge or provided food to the occupiers -- we are not looking into those events. We are concerned about those who have criminal, violent intent.

While the occupation is over, there is still quite a bit of work that needs to happen before the refuge can re-open to the public. I want to run through some of that with you now.

Next Steps

The Malheur National Wildlife Refuge remains closed, and it will remain closed for some number of weeks. During this time, law enforcement will continue to man checkpoints at the edge of the refuge to maintain the security of this crime scene.

Most immediately, FBI agents are inspecting and securing the buildings and any other areas of concern on the refuge to ensure that no one else is hiding. This process will take some number of hours.

Following that tactical clearing of the refuge, a team of FBI Special Agent Bomb Technicians, detectives with the Oregon State Police Arson/Explosives Unit, and bomb technicians from the Portland Police Bureau and Oregon Air National Guard will methodically work their way through the property to locate and mitigate any explosive-related hazards. This process could take several days.

Once the refuge is cleared of any hazards, the FBI's Evidence Response Teams (ERT) will enter to document and collect evidence related to potential crimes committed during the occupation. In addition, FBI forensic examiners from the Northwest Regional Computer Forensics Laboratory will work to recover and process computers and electronic devices. It will likely be several weeks before the evidence teams complete their work on the refuge, and it will likely be a number of months before the forensic examiners complete their analysis.

At the same time, the FBI is deploying experts with its Art Crime Team to work on the refuge. These agents are specially-trained in cultural property investigations. They will be responsible for working with the U.S. Fish and Wildlife Service and the Burns Paiute Tribe to identify and document damage to the tribe's artifacts and sacred burial grounds.

They will start with an archeological field assessment to determine any potential violations of the Native American Graves and Repatriation Protection Act (NAGPRA) and the Archeological Resources Protection Act (ARPA). This work will likely take a number of weeks to complete.

As the FBI works through each of these investigative processes, we will consult with the U.S. Fish and Wildlife Service as to how and when we will be able to return control of the refuge to that agency.

Closing Thoughts

Over the course of the last month, the people of Harney County have lived through an experience that is both highly emotional and physically exhausting. We have seen the occupiers and their outside supporters try to drive deep divisions between those who live and work here. We have seen some residents leave their homes, fearing violence against their families. We have seen the confusion, concern and trouble that the occupiers' actions have caused for this community.

This series of events has been beyond difficult for Harney County families. But, in the time I have been here, I have also seen the deep love that you have for this place you call home... love for the people, the land, and the way of life that makes Harney County so special. This passion for everything good about Harney County is what will help heal the community after this incident.

This is your community, and the FBI, along with our other law enforcement partners from across the state, are honored that we could be of service to you. We still have work we need to do -- and we continue to ask for your patience as we complete these necessary last tasks. We will do everything we can to return the refuge to its normal operations as soon as possible.

In particular, we know that the people of the Burns Paiute Tribe have specific concerns about the potential desecration of their ancestral lands and artifacts dating back thousands of years. As we complete the necessary safety checks and process the crime scene, we will work with the tribal members to ensure that our work remains sensitive to their historical and cultural concerns.

In closing, I want to thank Sheriff Ward for all of his hard work. I have never met a man who cares more about the people he serves... who cares more for the community in which he lives. No matter how you feel about the Hammonds or the situation at the refuge or the role that we have played here, Sheriff Ward has done exactly what he has promised to do since this all started back in November. He has worked tirelessly to ensure that the people he serves are safe, that they are heard, and that they can find a path back to normalcy.

Now, most of you probably want the tl;dr, and that's what I'm here for, right?

Collection is expected to take a few weeks, while full analysis may take months.

Said team consists of agents "specially-trained in cultural property investigations" who will be working in cooperation with both the U.S. Fish and Wildlife Service and Burns Paiute Tribe to fully assess and record any damage to artifacts, burial grounds, and other sacred sites. The big chunk there will be a full "archaeological field assessment" to look for violations of either NAGPRA or ARPA. This is expected to take several weeks as well.

In an email to supporters, Ammon Bundy criticized the U.S. government for a failed legal process. Federal lawyers prosecuted the Hammonds under an anti-terrorism law that required a five-year minimum sentence, though they have declined to say why.

Ammon Bundy wrote that the Hammonds are not terrorists and didn't commit any crimes. He also shamed the Harney County sheriff for not protecting the Hammonds. The sheriff didn't respond to calls from The Associated Press.

Ammon Bundy and other right-wing leaders have called on armed militia around the country to come support the Hammonds.

A call for participants in the peaceful demonstration said they wanted "to make it clear that our community isn't silently complicit with these groups and their intimidation tactics."

"If what is happening to the Hammonds is allowed, it will set a standard of what these powerful people will do to all of us," Ammon Bundy wrote in an email, referring to the federal government.

The Hammonds have not welcomed the Bundys' help.

"Neither Ammon Bundy nor anyone within his group/organization speak for the Hammond Family," the Hammonds' lawyer W. Alan Schroeder wrote to Sheriff David Ward.

Dwight Hammond maintained in an interview with The Associated Press their case isn't about fires: It's the climax of the government's efforts to take their land at a time when saving endangered species has gained in importance.

Over the years, the government chipped away at their grazing allotments, taking some and increasing fees on others, Dwight Hammond said. New federal rules made it harder to renew permits.

After father and son were convicted of the arsons, the government declined to renew their grazing permit. The family is appealing that decision.

"We paid hard dollars over fifty years ago for the right to graze. It isn't right for them to take it away from us," Dwight Hammond said, adding they've had to rent pastures from other ranchers to keep their cows fed.

In an opinion piece published this month in the Burns Times Herald, Oregon's U.S. attorney, Bill Williams, said the Hammonds received a fair trial and lawful sentences.

Williams said the government has never called the ranchers terrorists, and prosecutors acknowledged they were good people who contributed to their community.

Referring to the militia, Williams said: "Any criminal behavior contemplated by those who may object to the court's mandate ... will not be tolerated."

This is nuts. In what universe is occupying a federal building considered a good idea? Makes me wonder just how high these rogue protesters were.
You'd better believe I'm a bitter Bernie Sanders supporter. The Dems fucked up and fucked up hard. Hopefully they'll learn that neoliberalism and maintaining the status quo isn't the way to win this election or any other one. I doubt they will, though.

Seems a bit overkill, at least at the moment. Not sure what the full extent of charges is that could be applied to the militia for seizing the building, but they haven't shot anyone yet, and the two are support to turn themselves in on Monday, so they've got a day to go still.

A quick siege filled with copious amounts of tear gas being piled down on them should do the trick. Most of these Radical Libertarian types are more talk than action.When the chips are down they will show themselves as the cowards they are.

I at least am doubtful others will pick up the banner. Now, it could happen if the Feds *really* fucked things up - i.e. a shot goes off and the entire building gets slaughtered - but even then, I'd say long shot at best.

Though I'd use less provocative terms, yes, if they don't surrender after the talks. I doubt they have a hundred, and further doubt any more than half at most would actually be willing to risk death over this in the morning. Gas or smoke out the rest, then deal with anyone left if it comes to it

An option as well, doubt they brought much with them. That said, I imagine the feds would prefer to avoid a siege (though it'd be better than going in guns blazing), due to the chance of creating a lasting show and inspiring others. It not going to last "years" no matter what, the question is how many days does it last, and how many bodies are there when it ends?

It is a careful balance between trying to resolve the situation as fast as possible to save the hostages (I presume they have them) and not allowing them to martyr themselves by sending in the tanks immediately. That said, ultimately, if they want to martyr themselves they probably will. But as always, a peaceful solution is preferable if possible.

Honestly, seems pretty pathetic. Like a few years back with that Bundy guy in Nevada, except over something even stupider than that. Peaceful protest my ass. Grabbing your guns and taking over a building isn't a peaceful protest. At the very least, it's trespassing and a disturbance of the peace.

Just wait though... by the end of the weekend, Fox will be announcing the "second American Revolution" for the umpteenth time in a few years.

No hostage. The staff was on breaking, and the building was therefore unoccupied when seized, thank goodness.

Agreed on the balance - you don't want them to sit there and preach for a week, but you also don't want to crush it brutally.




It's worth noting, cutting power could be an issue considering the temp there - Local news reports the temp as 14 Fahrenheit, currently. Cut the heat, you risk either killing people or them starting to burn shit. Maybe if it escalates to them refusing to stand down, it'd be worth a try, but there is that consideration if you're still seeking a peaceful and minimally damaging ending.

Oregon public broadcasting -

"The militiamen broke into the federal building with supplies, including food and a generator."

"“In public, they haven’t asked for our help,” Bundy told OPB. “In private, we’re still needed. I talked to Dwight Hammond…for probably close to an hour. His conclusion is basically, ‘I do not want to be shot in the head.’ He had fear that if he actually rejected what was going on, and stood up for the abuse in what was going on, there would be somebody who would actually kill him. Fear, is what their problem is.”

Ammon Bundy writes that if the Hammonds are imprisoned, “there will be some serious civil unrest.”

And militiaman Ryan Payne said he will do “whatever it takes” to support the Hammonds.


Tl;dr - Hammond doesn't want to fight, Bundy and the militia will stick up for them anyways, and they've brought gear with them to stick around in the event of a siege.

Note: Local sheriff says the community mostly just wants the militia to leave - most are out-of-towners who've come specifically for this cause.
