1) I had the misfortune to read this thread's title after having previously read this.

2) Basically the OP could only have managed to be more clearly sarcastic by inserting a "This is sarcasm you nonnies" at some point in the OP.

3) I don't think this is a stereotypical excuse/alternative explanation (for rape, at least). In fact, I can scarcely believe it was made and I struggle with its success.

4) If I think of another odd explanation that I am aware of... at least sleep sex is a thing (although in the only case I am aware of where it was a defence argument it didn't work... not sure if that was in relation to the idea itself or just the person in question: certainly the man never sought treatment, which the first link says exists).

finding the article so implausible I did do a bit more digging to find out what the extenuating facts might be. It does seem that this was a case of drunken fumbling on both parties. The girl may have pulled him towards her and allowed some groping - as he alleges - before snapping out of her stupor to find a virtually naked man on top of her. That he might have been quite willing to use her drunkeness I don't doubt and the story of 'falling and semen covered hands' seems a bit iffy when taken out of context.
Nonetheless the article is not entirely factual and does seem to be somewhat biased with its presentation of teenager vs millionaire. The Jury seemed to have be convinced of something else entirely and I really have no compelling reason to think the a London Court and Jury was either corrupt or stupid

That may be correct. Many people just don't seem to realise that just because someone is a drunken coquette that it isn't OK to force oneself on them, and that unfortunately extends to our judges and jurors as well. As an American I'm not particularly familiar with what parts of England are chav country, and I hadn't noticed this thread before I started another one questioning the medical possibility of the fall this man claimed. As soon as I saw "millionaire" in the title of the Fox article I linked to, I figured money had gotten him off, but was dismayed that the British court seems as credulous as I'd expect from a Saudi one.
