It is very difficult to actually know what happened. Every rape case is essentially words against words. No matter how much physical evidence exists, one can (usually) never be certain that a party is telling the truth regarding his or her intentions.

Relying on news reports is very bad. They might give good insight, but in a case like this, there is probably going to be some bias, whether the news outlet takes the view in support of feminist movements, or just the view that rape trials have evolved to a point where there is an unfair advantage for the accused. Likely, there is also much information that is omitted by the news outlet for the sake of simplicity, sensationalism or due to a sheer lack of understanding.

The stories given by the individuals involved are said in a certain context, which can be hard to translate and include when summarizing thousands of words into a single sentence or two.

I just wanted to say that one should always be wary when playing lawyer online without actually knowing all the facts of the case at hand, especially when provided by commercial news outlets.

If you have access to a law database, or if the case digests are published online, I suggest looking up the statements made by the judges. Usually, they give a much more balanced, comprehensive and unbiased consideration of the facts.

A flat can be a dingy two-room apartment, but there's nothing preventing a flat from being a whole penthouse floor with diamond encrusted toilet seats in all of the fifty-two bathrooms. Hyperbole, of course, but just because something is an apartment it's not automatically cheap and lower-class.

I have represented clients in cases where everybody was drunk and stoned. It is difficult to sort out whatever might amount to informed consent under those circumstances, and difficult to establish how anyone could have any specific rational intent to do anything at all. It's a miasma.

I am sure that date rape is a real thing. But so are situations where no party has enough active grey cells to form any kind of mental state whatsoever.

Since this happened in the UK I think that the reason why he was found not-guilty when he so obviously was had to do with his ethnic and religious background. The jury most likely found him innocent in fear of being called Islamophobes or whatever. I would like to think that this is unlikely, but since the whole fiasco with the Muslim rape gang last year I can't help but see it as this way.
