Cruel and unusual punishment: Torture, deliberately degrading punishment, and/or punishment far too severe for the crime committed.

I believe your suggestion fits all three of those attributes.

The punishment fits the crime. If someone willingly listens to it or forces others to, I see no problem with killing them with their own malicious weapons.
