Actually I think the President could refuse to fulfil a duty of office without being imprisoned for contempt. There was the case of Paula Jones in 1997 but the Supreme Court ruled that way specifically because the suit was about Clinton's behaviour outside his official duties as President (in fact from before he was President) and they also didn't compel him to attend the civil trial.

There aren't that many explicit duties of the President. But he could refuse to address Congress on the 'state of the Union' or refuse to put forward names for his Cabinet, for instance. My guess is that SCOTUS would stay out of it, definitely NOT imprison the President, and say this was for Congress to deal with by impeachment if they saw fit.

So the solution here is actually a smaller government? If so, that county clerk accidentally did the taxpayers a favour by making her superfluousness so very visible to the public.

I'm pretty sure that couples are required to pay a small filing fee if they wish to obtain a marriage license. In that case, Mrs. Davis was actually placing a burden upon taxpayers by refusing to issue marriage licenses.

I'd consider doing that, and I'm not gay.

SCOTUS didn't make a new law. Rather it declared all SSM ban laws unconstitutional due to the 14th Amendment.
