No, just maybe the justice system in Texas. Again, I didn't mention the other states so it is entirely possible they too have accepted this mechanism.

I don't see the relevance though, you can't appeal until there is a sentence (otherwise there is nothing to overturn). If you went by normal trial, its irrelevant (the trial by combat can't be a ground for reversing the outcome) and if you went trial by combat, you can't overturn a ruling that resulted in your death in the field.

Sure, but I'm still not sure the scenario you've outlined would be what would actually transpire.

I hope you guys realize, out of ALL of the near 8,000 people sentenced to death since the death penalty was reinstated in 1978, only 1,408 have actually been executed. The odds are literally better going the way of the death penalty, with just over a 17% chance of being executed within the next 40 years.

A normal trial thanks. Not only is trial by combat entirely dependent on who's the better fighter (and I'm willing to bet, that it's probably the other guy.) it's also pretty much aknowledged the world over as bullshit and I'm not keen on having to kill someone to prove my innocence of a crime.
