Actuall cops said the flags were street legal, specifically the highway patrol. Here's a link to back that up.

BTW, I don't object to the flag on this car:
It might flap around and cause a "distraction" but with the flagstaff centered on the vehicle it can't flap too far out to either side and actually obscure another driver's view. That's what most concerns me.
