Doesn't matter. You can't shoot a fleeing assailant, regardless if they're on your property. Funny thing, the police can't either.

Doesn't matter. Castle Doctrine states that as long as they're on his property and he feels they'll harm him in the future he is exempt from prosecution.

Andrea Miller is dead. Ton Greer is not. Seems to me like he came out of the altercation better off.

Now the judiciary should determine whether he acted in accordance with the law.

Does Castle Doctrine apply in California?

It applies in literally every US state. And in most first world countries in general.

The framework for the US judicial system was created by angry men with guns. They set up the most influential part of it, the Constitution.

It seems perfectly sensible to me that an angry man with a gun today would be considered by the same standards, and the derivatives, that they laid out.

Uh, the Founders really weren't angry men with guns. In fact, the only one who was on the front line was George Washington.

Castle Doctrine does exist in Cali, I believe the code is 198.5 (I know it's in the 190's)..... though this incident falls just outside of it, technically, from my reading of it earlier. Not that it makes much difference. I doubt the charges will actually be filed come Monday, and even if they are I'm absolutely certain that the result would just be a mistrial, and after Polling the DA would chose just not to refile.

Actually, it says Immediate future, as in right then and there. Once they are fleeing, Castle doctrine no longer applies.

Can you really condone in any way the shooting of someone running away and begging for their life?

So it's not just Florida that has castle laws? I see.

This makes me happy. The poor old man won't be re-victimized by the law then? They won't file charges in the end you think?

I'm glad the DAs in the US have some tools they can use to decide who they'll go after and who they'll spare.

Yes when mere seconds ago they were trespassing, robbing, beating up a frail old man.

Andrea Miller. That's the name of the dead person.

And you're right, if she hadn't broken into the place then she would probably be alive. But the question is whether Mr. Greer killed her legally. I don't believe that he did.

From what the article described, if they were running into an alley, unless Greer's house bordered that alley, then they were not on his property.

That part about Castle Doctrine in literally every state is a bit of a stretch.
