When it gets in the way of protecting individual freedom and liberty for all? Yeah, we should.

Fuck the Constitution. Fuck what people 200+ years ago wanted. We in the present should not be constrained by the tyranny of the past. The Constitution is not an excuse for the continued oppression freedom-haters want to enforce.
