Serve the same dishes, decorate the same way, and do anything the racist guy does unless he has a trademark or anything silly like that. I'm sure you would get some customers other than those denied by the first restaurant as well.

Depending upon how much sympathy there is in society for the prejudices the restaurant owner in question has, this could do everything from annihilating his business, to leaving both firms intact, to bankrupting the restaurant which tried to open in protest against him. I prefer not to leave this sort of thing to a roll of the societal dice, and so hostile legislation is the means I choose to stop such prejudicial business practices.

Exactly. The idea is to guarantee people a better answer as to how to redress their grievances against a public accommodation which is discriminating against them than a shrug and an apathetic "Meh. Go find somewhere else to do business."

The argument that the market will simply fix such things itself assumes that an alternative vendor of equivalent or superior quality which doesn't discriminate on the grounds its competitor does either is presently or eventually will become equally available. I see no reason to assume that in a climate where there is great sympathy for discrimination on the basis of [insert unpopular characteristic here].
