1.Switzerland isn't an EU member.
2.The EU doesn't dictate anything about immigration laws. People moving from, let's say, Spain to Lithuania are immigrants exactly as much as people moving from California to New York are.

It'd be better if Switzerland would work to catch and extradite tax evaders and other criminals though, borders are the dumbest solution to problems like this and most likely the most costly. Neutrality is good but there is such a thing as taking a gimmick too far.
