They seem to have exceeded the scope of the warrant.

I think this man deserves every penny he claims.

Misspelling somebody's name on a warrant is a screw up. Subjecting a person to 15 hours of anal probing for no reason but petty malice is a crime.

Hahaha! Hahaha, South Park is so funny. I know it's revolting, but I still find South Park humor hilarious.

...what? This isn't from South Park?

This is real?

Seriously?

I'm getting off. I'll go crazy if I hear any more of this nightmarish shit.

So what crime did they commit? Pretty hard to commit a crime when you've supposedly been given legal permission to do it.

Read the complaint, there appears to be case law saying that the warrant must specifically list the medical procedures used, rather than just a generic do what every you want to this man's anus.

Read the complaint? I'm the one who posted the complaint. I'm the one who just brought that to everyone's attention. Pursuing a case with a dodgy warrant is gross misconduct. It's not rape.

Problem being they weren't given legal permission to do so. What with the improper filling out of the warrant, it not being valid where he was, it's deadline having already been reached and it being overly broad to begin with thus making the medical procedure outside of its scope and thus, not bound in any legal cover regardless of the other issues at hand.

Thus: Dude got stuff shoved up his rectum against his will with no legal reason. IE: rape, in the common parlance of the day the kids are using these days.

Note the word supposedly.

Note also that the plaintiff, is not claiming rape.

I seriously can't even believe this. There's nothing to justify this. You just can't defend that.

Those people are so getting sued; it's almost funny how quick this is gonna be.

I think that some of the officers would have felt themselves at home within the ranks of the Stasi - maybe even the Khmer Rouge.

They didn't unlawfully torture or kill people or did it in a very gross manner yet that was never [properly] prosecuted, and those happen with a somewhat sad common frequency.

It was massive breach of bodily sovereignty in a gross manner. His anus was probably dying. All because he ran past a stop sign. Ridiculous.

Sounds like South Park might be making an episode off of this if it gets big enough. It's like Cartman Gets an Anal Probe times four for drugs that don't exist.

Not really.

The search warrant and the first search may have been reasonable. It's hard to judge when I wasn't there. However, they should have done it in the correct county and after they searched and did not find narcotics, they should have let him go. The enemas and the colonoscopy were going too far.

Even the search warrant was suspicious at best, since they'd had a previous run-in, and I'm not sure that "He's clenching his butt tightly" is really probable cause for a bodily cavity search for drugs, even when a dog allegedly gets a positive result from a car.

Even if it was, I think that was overkill for body cavity searches.

I hadn't known there was a previous run-in. That is suspicious -- as in makes me suspicious the cops were purposely harassing him. Either way, they took this to an extreme that was clearly unjustified. You can debate at what point they crossed the line, but it's pretty obvious that they crossed the line.

This 4 On Your Side investigation looks into the actions of police officers and doctors in Southern New Mexico.
A review of medical records, police reports and a federal lawsuit show deputies with the Hidalgo County Sheriff's Office, police officers with the City of Deming and medical professionals at the Gila Regional Medical Center made some questionable decisions.
The incident began January 2, 2013 after Eric Cartman finished shopping at the Wal-Mart in Deming. According to a federal lawsuit, Cartman didn't make a complete stop at a stop sign coming out of the parking lot and was immediately stopped by law enforcement.
Cartman's attorney, Shannon Kennedy, said in an interview with KOB that after law enforcement asked him to step out of the vehicle, he appeared to be clenching his buttocks. Law enforcement thought that was probable cause to suspect that Cartman was hiding narcotics in his anal cavity. While officers detained Eckert, they secured a search warrant from a judge that allowed for an anal cavity search.
The lawsuit claims that Deming Police tried taking Cartman to an emergency room in Deming, but a doctor there refused to perform the anal cavity search citing it was "unethical."
But physicians at the Gila Regional Medical Center in Silver City agreed to perform the procedure and a few hours later, Cartman was admitted.
What Happened
While there, Cartman was subjected to repeated and humiliating forced medical procedures. ...

Basically, Cartman gets an anal probe. It's South Park all over again!

Srsly: Land of the Free strikes again.
