Rand Paul Pushes for a constitutional amendment.

Forget the Vitter amendment. Rand Paul wants to make sure that Congress can’t ever again write laws with provisions specific to lawmakers.
The Kentucky freshman Republican has introduced a constitutional amendment that would preclude senators and congressmen from passing laws that don’t apply equally to U.S. citizens and Congress, the executive branch and the Supreme Court. The amendment is aimed squarely at Obamacare provisions specific to members of Congress and their staffs that became a central point of contention during the government shutdown.

Under Obamacare, Capitol Hill aides and lawmakers are required to enter the law’s health exchanges and a summertime ruling from the Office of Personnel Management ensured they will continue to receive federal employer contributions to help pay for insurance on the exchanges. A number of lawmakers, specifically Sen. David Vitter (R-La.), have been pushing for the end to those contributions, arguing they amount to a Washington exemption from Obamacare. Vitter has drafted legislative language that would eliminate these subsidies and tried to attach the measure to an energy efficiency bill and pushed for it to be included in the government funding bill last week.

Paul seeks to go a step further and amend the Constitution so that “Congress shall make no law applicable to a citizen of the United States that is not equally applicable to Congress,” the executive branch including the president and vice president as well as the Supreme Court.
Paul told the Daily Caller in September that the amendment would take specific aim at Supreme Court Chief Justice John Roberts, whose swing vote upheld the constitutionality of much of the Affordable Care Act.

“If he likes Obamacare so much, I’m going to give him an amendment that gives Obamacare to Justice Roberts,” Paul told the publication.

Amending the Constitution is no easy task, requiring super majorities in both chambers of Congress before going to the states for ratification. And Paul in particular will face the immense burden of trying to convince lawmakers that they should no longer have the authority to make laws governing Congress.


I for one see no reason why this law hasn't existed in the first place, last I checked "all men are created equal" therefore everyone should be subjected to the same laws.

I agree. Rand Paul should, like everyone not in Congress, be legally barred from voting on bills before Congress.

American Libertarians and Anarcho-capitalist are generally only libertarian when convenient for them. When it comes to something they don't like, such as gay marriage, they want it regulated harder than Orwell's sweatiest nightmares.

Nice to see that Paul is totally committed to the welfare of the American people, and is in no way driven by petty politics and personal vendettas.

The idea is quite simple.

By noting that it is exempt, and omitting why it is exempt, it implies that the Affordable Care Act is dangerous, and likely to negatively effect people under it.

Something similar occured over vaccines in Germany a while ago - vaccines for parliamentarians, members of the military and police etc. were different for the ones for the common man. Raised a shitstorm. That they were different (More specifically, older) because they were based on a much older contract with whoever supplied them that one couldn't get out of was kinda, sorta omitted.

Except that they're not actually exempt.

The story basically goes like this.

1. Congress received healthcare through it's employer (ie, the Federal Government), just like all other Federal Employees
2. Under Obamacare...nothing about this arrangement would have been changed, just like no 'ordinary citizens' with employer provided healthcare have to go buy a different plan through the exchange.
3. Chuck Grassley got it into his head that it would be a brilliant ploy to insert an amendment requiring Congress to buy insurance on the exchanges, because obviously the Democrats would never go for that.
4. The Democrats went for it.
5. The Office of Personnel Management said, "Okay, so the money that Congress would have been receiving anyway as per their employer health insurance will just be used as a subsidy on the exchange.
6. Republicans realize they look like idiots, and start screaming "exemptions!" and "liberal elites!" and "Vitter Amendment" and basically just continuously throwing shit at the wall hoping something will stick and cover up the fact that this entire manufactured scandal is meant to cover up a failed political stunt because, I don't know, I guess they're tired of failing over and over at these.

I really do not understand What ACA provision does he think Congress is exempt from ?

The only issue with congress and the ACA is that Congress forgot to include provisions for funding for Congressmen to buy insurance on the exchanges ( which the law requires they do). Now the President interpreted the statute to bring money the old government workers insurance which congressmen had, but that is not some special congressional exemption.

There is an argument that it is unequal because several of the other groups that congress forgot to provide funding for purchase of insurance simply got an exemption from the mandate rather than the President interpreting the law, though there is a reason for that no one will have standing to challenge the congressional care employers would have standing to challenge the lapse in the law.

That's the point NiS was making. Saying they are exempt but not revealing why puts a kernel of doubt in the minds of the ignorant, weak-willed and reactionary. Which sets them off and generates pressure.
