Although I'm not a big fan of Silvio Berlusconi, I believe he should be able to voice his views without risking a trial for them. Only in a society where the orthodoxy of the political caste can be challenged can there be democracy and honest debate. And criminalised racism, with hate speech laws as a precedent, can be used by the political caste to make others utterly incapable of challenging the 'political mainstream'. It doesn't even matter if someone is racist - the accusations are enough to disrupt their political career and stifle honest debate.
