It really isn't. Your initial complaint was that drunk people do things that don't hurt anyone but themselves.

Now if you'd gone with the amount of violence done by drunk people or the amount they tax the health service then you would have had a decent point.....

If both people consent then it is not rape. If it can be proved in court that it is not consensual for either party then it is rape. Alcohol consumption is irrelevant.
