No, not really, considering "false accusations" make up about 2% of all cases and convictions average 3% anyway. As a man, being accused or convicted of rape is something I know for a fact I will probably never have to worry about, ever.

"Knows what's going on" was my shorthand for explaining that.

It's hurtful to those who can't drink because of their religion. Or those who are using medication that, for one reason or another, doesn't work well with alcohol. Or those who can't get laid. Or puritans.

By the letter of the law, both are technically guilty of rape, and victims of it.

However, if you're watching Law and Order: Special Victims Unit, then only the male participant is guilty. Not kidding, saw an episode recently with the same issue. Their position was that the male was responsible for his actions, and the female was not, despite both being intoxicated. I've also seen instances recently of other people sharing the "male is guilty" viewpoint of this issue on NationStates threads...

So while according to the law, both is guilty, I think there is a social stigma that says the male is the one who took advantage of the other in the "both are drunk" situation, and thus he is the guilty one.

Just avoid sex while you and the chick(s) (or dudes if that's what you prefer) are drunk. It's safe.

If the girl consented to have sex with you, and you didn't drug her drink or anything then it's not rape.
