In the realm of human experience, what usually happens is you have an awkward conversation and go home and the two of you don't associate anymore.

... Or you're accused of date rape.
And will most likely be convicted of it.
Rightfully so, according to your standard.

Often, the two combine, sometimes for better, but sometimes for worse. Acquaintance rape is on the rise, and has been for a while. I've been worrying about falling into it, and often just go to bars to drink, not to pick up chicks or even socialize. I would much rather avoid hurting someone and subsequently hurting myself with jail.
One question that has plagued me is this: if I'm drunk, and the girl I have sex with is drunk, is it rape?
The stereotypical acquaintance rape is when a man intoxicates a woman with a narcotic, directly or indirectly, to take advantage of her.
So, I ask: if both parties are drunk, is it double rape? Is rape nullified? Should either party report the other to the police? Should both parties be put in jail?

No, not really, considering "false accusations" make up about 2% of all cases and convictions average 3% anyway. As a man, being accused or convicted of rape is something I know for a fact I will probably never have to worry about, ever.

You can if you couldn't consent at the time. Being drunk is considered that.
"Drunk" is a very wide term, sleeping with someone after a beer or two obviously isn't rape. When they're too drunk to know their own name obviously is rape.
"Knows what's going on" was my shorthand for explaining that.

It's hurtful to those who can't drink because of their religion. Or those who are using medication that, for one reason or another, doesn't work well with alcohol. Or those who can't get laid. Or puritans.
