If both say yes, and there is no threat of harm if someone says no i.e. not knife to the throat or threat of harm to one's family, then it is not rape

If one party says no, and DO have sex with them, then it is rape.

It depends on how you define "drunk," generally if a party is two drunk to drive it is rape. As to both party, if one is significantly more drunk or more impaired, than that is the Vicdom otherwise it is mutual rape: prosecutors don't like to prosecutor feamail on mail rape. The exception is if the couple discussed potential sex before drinking. And all thees perpetrators should go to jail including mutual rapists.

The problem isn't drinking, the problem is that drinking is used by men to excuse rape. "She was drunk!" is the rallying cry. Unless someone freely says yes, it is rape.

In a word, no.

As a rule of thumb, if they know what's going on and are happy with it, then it's not rape.
