And what makes the Supreme Court infallible and "ultimate"? They can simply say that the Constitution is what they want it to be.

Oh, you mean the Schemp-Murray cases? That was an example of judicial activism. Also, the First Amendment simply prevents the government from establishing a state religion.

And the 1st amendment protects us from the government establishing a religion, like the Church of England, not protecting from the ideas of the religion and government intermixing.
