Because some people are under the impression that you have to read him his rights AS YOU ARREST HIM NO MATTER WHAT, even if he's bleeding out from a bullet hole in his neck and was subsequently sedated for a few days.

Most likely it will only re-enforce a fully exercised one, which is treatment of enemy combatants. Jaywalking or speeding does not make one an enemy combatant, blowing up a public square in likely pretext of holy war and resisting arrest with deadly force however does. American citizens can be identified and dealt with as enemy combatants did, and this is not a new concept as it has been somewhat informally practiced ever since WWII in rare occations.

Anyhow he was critically wounded last time I checked and in intensive care, was he ever concious enough to even recive the reading?

One beep on the life support for Yes, two beeps for No.

It's the same petty shit that people pull when they just say "STRAWMANG" or whatever fallacies they can think of. Explain the shit you don't get or what you think is irrelevant. You're saying we shouldn't defend Nazis in court and I'm saying the ACLU is extending the clause in the Const. where it says that everyone is allowed a counsel.

Strawmanning! That's the term I was trying to remember. I have decided I will no longer respond to Strawman responses. Or insults. Adios.

EDIT: Another thing I won't respond to: Self-proclaimed debate victories.

Sounds like you are advocating guilty until proven innocent.

They do not intend to read him his rights when he does wake up. BTW he's already been arraigned and charged today, still without Miranda. Yet they say his still has his Miranda rights: he can refuse to talk, and have a lawyer present (who, unless he's just a government stooge, will advise this client to shut up). Which, it seems to me, makes not Mirandizing him not all that useful.

BTW you people who object to the way they shut down Watertown to catch a terrorist who had guns and possibly grenades and bombs...get real.

This would be true... if it were true.

Relevant part:

A senior congressional aide said Tsarnaev had asked several times for a lawyer, but that request was ignored since he was being questioned under the public safety exemption to the Miranda rule.

So, failure to read Miranda, denial of right to an attorney, both until a judge arrived and held court in the hospital room. We're off to an amazing start.

What's sad is that, after two days of questioning and denying his right to an attorney, a judge had to show up and read his rights personally, then assign an attorney.

Shit, I was trained to uphold the law and the public when I served, not shit all over it.

I am disappoint.
