Actually, no, they don't. The government has the right to regulate it, not to enforce it. Combined with the fact that it's illegal to break up a peaceful gathering—and I'm honestly not sure which of those would take precedence Constitutionally, so I might be right even if your example is valid—and it is not within the government's rights to throw them in prison.

If it was a peacefull gathering the would have been allowing trucks into oakland harbour.
