Man Spends Six Years In Jail On False Charge

So, today I was reading through the news, and I found this story.

The story is ridiculous.

LONG BEACH, Calif. — A former high school football star whose dreams of a pro career were shattered by a rape conviction burst into tears Thursday as a judge threw out the charge that sent him to prison for more than five years.

Brian Banks, now 26, pleaded no contest 10 years ago on the advice of his lawyer after a childhood friend falsely accused him of attacking her on their high school campus.

In a strange turn of events, the woman, Wanetta Gibson, friended him on Facebook when he got out of prison.

In an initial meeting with him, she said she had lied; there had been no kidnap and no rape and she offered to help him clear his record, court records state.

But she refused to repeat the story to prosecutors because she feared she would have to return a $1.5 million payment from a civil suit brought by her mother against Long Beach schools.

During a second meeting that was secretly videotaped, she told Banks, "`I will go through with helping you but it's like at the same time all that money they gave us, I mean gave me, I don't want to have to pay it back,'" according to a defense investigator who was at the meeting.

It was uncertain Thursday whether Gibson will have to return the money.

Prosecutors also said they didn't immediately know if she might be prosecuted for making the false accusation when she was 15.

Gibson did not attend the hearing on Thursday.

Banks, once a star middle linebacker at Long Beach Polytechnic High School, had attracted the interest of such college football powerhouses as the University of Southern California, Ohio State University and the University of Michigan, according to the website Rivals.com, which tracks the recruiting of high school football and basketball players.

Banks said he had verbally agreed to attend USC on a four-year scholarship when he was arrested.

He still hopes to play professional football and has been working out regularly. His attorney Justin Brooks appealed to NFL teams to give him a chance.

Banks said outside court Thursday that he had lost all hope of proving his innocence until Gibson contacted him.

"It's been a struggle. But I'm unbroken and I'm still here today," the tall, muscular Banks said, tears flowing down his face.

He recalled being shocked and speechless on the day Gibson reached out to him after he had been released from prison, having served five years and two months.

"I thought maybe it wasn't real," he said. "How could she be contacting me?"

He said he knew that if he became angry when he met with her it wouldn't help, so he struggled to keep calm.

"I stopped what I was doing and got down on my knees and prayed to God to help me play my cards right," he said.

In court, Deputy District Attorney Brentford Ferreira told Superior Court Judge Mark C. Kim that prosecutors agreed the case should be thrown out. Kim dismissed it immediately.

Banks had tried to win release while he was in prison, but Brooks, a law professor and head of the California Innocence Project at California Western School of Law in San Diego, said he could not have been exonerated without the woman coming forward and recanting her story.

Brooks said it was the first case he had ever taken in which the defendant had already served his time and had been free for a number of years.

Banks remained on probation, however, and was still wearing his electronic monitoring bracelet at Thursday's hearing. His lawyer said the first thing the two planned to do was report to probation officials and have it removed.

"The charges are dismissed now," Brooks said. "It's as if it didn't happen. ... It was the shortest, greatest proceeding I've ever been part of."

Banks had been arrested after Gibson said he met her in a school hallway and urged her to come into an elevator with him. The two had been friends since middle school and were in the habit of making out in a school stairwell, according to court papers.

There were contradictions in Gibson's story, as she told some people the rape happened in the elevator and others that it happened in the stairwell.

A kidnapping enhancement was added to the case because of the allegation Banks had taken her to the stairwell. That enhancement also was thrown out Thursday.


Anyway, it brought to mind a few questions.

1. Should plea bargains be outlawed?

2. Are there any measures that should be put in place to keep things like this from happening?

3. What would be a proper punishment for Gibson, in your opinion?

4. What are your thoughts on this?

1. No. Usually, they serve their purpose just fine, and some justice is better than no justice. If anything, they need a better quality of lawyer.

2. Other than appointing better lawyers, none that I can think of.

3. Yes. She sent a man to jail for 5 years based on a lie, and fraudulently claimed $1.5 million in compensation for something that never happened. Is that really a question?

4. Send her to jail, give the guy $10 million in compensation so he never has to work again. Seems only fair that after having his life destroyed like that, he should be allowed to enjoy whats left of it.
Also make her pay the money back.

Sentencing her would have consequences, both good and bad. The good being the message it sends regarding false accusations. No one deserves to be falsely accused but at the same time, you don't want to deter legitimate victims from coming forward to seek justice rightfully deserved. Legitimate victims already face significant hurdles and often encounter prejudice when trying to report their attackers.

She should have to give the money back, but I don't think she should have to go to prison, for the reasons that Kryo said.

Suffering public scorn is good enough, and believe me I have plenty of scorn for her right now.

Apart from keeping the police trained and funded and keeping the right to appeal I can't see what could reasonably be done.

False convictions are bad. Having them overturned is good. This thread is going to be full of people claiming that this proves that women and feminists are evil.

I think that public scorn isn't a proper punishment for ruining the guy's entire life and taking a million dollars that she in no way deserved.

I would think a slightly higher punishment would be necessary. As in, at least five years in jail.

Surely if she's admitted herself that she made it up, on tape, then there's nothing else they can do? Isn't perverting the course of justice illegal?
Also, establishing strict parameters about what is considered proof of a false accusation wouldn't be impossible. If it came to it, just say that without a written/recorded confession, it can't be considered a false accusation?

2. Have her pay 2.5 million to Mr. Banks. 500k for each year he lost.

Yeah ... let's refrain from purposefully trotting out obviously over-the-top crap like this, especially in light of the rape thread and other issues our player base is involved in or discussing. That crosses lines. Kindly refrain from it in the future - thank you.

So saying that she deserves a ironic punishment some time in her life is barbaric? I show no sympathy to those who ruin others live son purpose via a lie. They deserve a ironic punishment if it is severe.

Sadly that can't happen, it should not happen to all but my god does it tick me off when people falsely accuse people of doing something they didn't do, it's not right.

True but some people have trouble recanting especially knowing the public scorn they'd face - as was noted earlier in this thread.

It is indeed a perversion of justice; outright perjury if she took the stand to testify. Setting limits on evidence can't be a good thing if we accept that some people may and can lie and never recant.

For sending someone to prison for YEARS? Potentially ruining the whole rest of his life? For no purpose except to steal money?
I cannot see any prison sentence as being long enough, but I will not endorse torture or the death penalty.
