Okay, returning to the topic...

Shel, I got the email that was sent out to all the signatories of the original. I signed the new petition. I still can't believe that the DA would be so bold as to say, and I paraphrase, "We aren't going to pursue this. Decision final. Enjoy your life."

But what I took special notice of was the letter that was sent. I read through all twenty pages (or was it just twelve?), and was pretty sickened by what I read. It actually makes this even less believable. I actually can't describe in any way my reaction to such atrocious actions undertaken at all levels of the justice system. What I had read would, and should, result in a major misconduct investigation.

At the moment, in Australia, this is a pretty big child sex abuse commission being undertaken here. Its main focus is on the lack of reporting by community groups of instances of child sexual abuse. And while I know you aren't, by legal definitions, a child, to hear of an instance where sexual abuse in general has been allowed to be ignored/covered up/forgotten/whichever other term you wish to use, it makes me wonder about the state of law and order in modern times, and whether the current perception of law and order is symptomatic of the state of same.

By strange coincidence, just this morning I read an article about a 16 year old boy who allegedly raped a 14 year old girl and who is now going free as the prosecutors feel that they cannot win the case. She claimed rape, he claimed consensual sex. And so the case goes nowhere...

It's really sad that it ends up like this.

It's sadly very common most don't even get reported, and when they do it often ends up almost pointless.

As most of you know, in January of this year, the District Attorney decided not to arrest and prosecute my rapist based on the reasoning of "too much reasonable doubt".
In July, I went and took a polygraph test: click here.
This proves that what happened in April of last year, regardless of anything, DID happen.

In September (this month),a letter was written to the US Attorney General, and the CA Attorney General: click here
We asked them to please review the decision that the DA made, based on reasons that are included in the letter.

This one urges the Attorney Generals to review the District Attorney's decision and makes it known to them that with what happened, with the polygraph, and with support from many people, they cannot just ignore the fact that there is a rapist on the streets.

Another update for you guys is that I have been an ICV at UCSD for the past year. During the past two quarters (winter and spring), I regressed into depression and did not do well in school. Because of these reasons, UCSD has decided not to accept my transfer to their school. They have given me the option of going back to UC Davis, the school where I was assaulted, or quit college altogether.

Thank you guys so much for all the support you have given me so far, and I hope that I can borrow your support again for just a little while longer. I am not going to be in Nationstates a lot, but I will come in every now and again and check in on this thread and also check my telegrams, if you would like to speak to me.

Thanks so much again, you guys. xoxo

Regardless of whether or not the letter made the situation "less believable" or not, these are the truths behind the justice system. I mean, down to the fact that in Pennsylvania, the sexual assault unit was jokingly called the "Lying Bitches Unit" ("One former detective from the 90s became notorious for nicknaming the Philadelphia sex crimes unit "the lying bitches unit" and publicly opining that women lie about rape "about half the time". http://www.theguardian.com/world/2013/j ... sis-crimes). The police do not always take sexual assault seriously, and the District Attorneys almost never take it seriously.

Law and order (in my humble, angry opinion) is a bunch of laws put up in frames on a wall that no one actually does anything about. Police and government officials can say that they think rape is disgusting and a stop needs to be put to it, etc. but are not willing to change anything about it.

It's a sad day, then, when this becomes the belief about the legal system. I can see what has made you come to that conclusion, Shell, don't get me wrong there, but if personal experience drives you to that, then it is indeed saddening, at the very least.

(By the way, Shell, what's with the number in the brackets? I'm a little confused...)

Welcome back Shellby

New petition signed and sigged.

I remain baffled as to how anything about your assault could possibly be considered "reasonable doubt". There's nothing ambiguous about hospitalisation.
Keep fighting, you deserve so much better than this.

Also, mayhaps one of the Mods - if you're agreeable - could edit the new petition into the OP?

Not rape, but I figured this is the appropriate place.

Got approached by a man yesterday, in the school parking lot while I was waiting for my boyfriend. It was right after school, but the parking lot was empty for the moment. He walked up to his car, which was behind my boyfriend's car that I was sitting on. He opened his car doors, started the engine and then stood and looked around for awhile. He then stared at me, and then continued looking around, before staring at me again. He got into his car, and pulled up, slowly, beside my boyfriend's car, leaving me stuck between a fence and his car. He rolled down his window, and asked if I needed a ride. I said, "No, I'm just waiting for someone," and turned away. He then introduced himself, and asked my name. Kind've freaked out, I told him my first name. He said he worked just over there, and I replied, somewhat peeved, that I went to the highschool right here, hoping he'd drop it, considering I was a minor. Instead, he went "Oh, well you're very pretty." Getting super uncomfortable, I replied, "Thanks, have a nice day," in a firm voice, and again turned away. He persisted, "Can I have your number?" And I said, "well I'm actually waiting for my boyfriend," hoping he'd at least respect another man's territory, if he didn't respect my own disinterest. "Can I give you my number?" He wouldn't stop so I said "I guess," figuring that it couldn't hurt, and that he'd probably leave me alone. He gave me his number, and I was like, "Okay, bye."

But he didn't leave. He went "Text me." And I pretended to not hear. He insisted, "Text me!" And I went "yeah, sure," fully intending to never contact him. So he persisted, "No, text me!" So I did, afraid of what he was going to do. He waited until he got the text, and I hoped he'd leave. But he wasn't finished yet. "Can I call you?" I said, "Yeah, sure." And he continued, "All the time, like any time of day?" "Fine, sure, but not at night." At this point I'm tired, extremely defensive, and exceedingly uncomfortable. "I'll call you," he says. I interrupt, "how old are you?" And he says, 32, and asks me my age. I tell him 17, in a shocked, and indignant tone. "Oh, you're very pretty." He continues, appearing completely unperturbed by the information. "It was nice to meet you, you're the most beautiful girl in the world." I reply, with an edge, "Thanks, bye." "I'll call you," he repeats. "Okay, bye." And he finally drives away.

I don't move for at least a minute after he is out of sight. I turn around, and try to collect my wits, as my boyfriend comes into view. My legs are weak as I get off the back of my boyfriend's car. Panicky, I rush up to him, and tell him what happened. The man phones me, and I ignore the call. My boyfriend apologizes profusely, and I know he blames himself for what happened. He is also angry, and tells me that if the man phones again, he's going to answer it. The man does, less than 5 minutes later. My boyfriend answers it, and only gets out two hellos before the man hangs up. We drive home, and I receive a text from him: "Hey [name] u kidding me it's ok hony! But I never forget ur beauty! This the first time in by my life! Please if you can just normal friend? He is lucky ur boyfriend!!!" [SIC]

Like shit, I know exactly what he wants, and it's got nothing to do with being friends. There is no reason someone that old hangs around someone my age, other than sex(read: Rape). So my boyfriend and I agree we have to do something to get him off my back. So I tell him to call him back and deal with it, thinking he'd listen to a man better than a woman. My boyfriend dials his number, and starts, "Hi, this is [name]'s boyfriend. I don't want you contacting my girlfriend ever again. She's a minor and it is completely inappropriate." The man is fervently apologising, and saying he did not know. He continues, "I would advise you to lose her number because if I ever catch you again... She may be nice, but I am not." He hangs up, his point made. He tells me to write down everything I can remember, including a description of the man, and his car. I feel like an idiot for not noting his license plate number. But I have his name, and phone number, and he tells me I should report it to my school. I record everything I can remember, and for the rest of the evening I hear nothing.

The next morning, I march into the office with my notebook in hand, and tell the VP. I spent about half an hour recounting the story to him, and discussing what to do about it. He says he is going to phone the police, and that I can go back to class but they may want to talk to me. I return to class, and see another text from him, "goodmorning [name]." I ignore it, and about fifteen minutes goes by and I get a text from my dad, asking if I want him there while I deposit a statement. I say yes, and another fifteen minutes go by until I'm summoned to the office again. This time, the meeting lasts about an hour with the police officer. It takes me three sheets to write everything down, and get the details straight. I'm nervous, and I leave out parts while I'm writing it. Eventually we finish, and the officer tells me that they're going to have a talk with the guy, and to let them know if he tries to contact me again. I go back to class (it was technically a spare, but I figured I'd make up for lost time) but it isn't long before I'm called back again. They need a description of the guy, and they wanted to talk to me more about staying safe. As I write the description, she tells me to call emergency if I ever see him again. By the time I get back to class, two periods have gone by as well as my lunch time, and I am going to be late for my next class.

And that is how my day went. Plus a similar aged man creeping on me at work. But somehow it just seems like a normal occurrence at this point. Funny how one can internalise such harassment as "normal". Constantly having boundaries stepped over, my consent disrespected, and my human being objectified, and it just feels like something I have to accept. This is a part of rape culture that tells me I must be polite to my aggressors, and that it's my faults because I wore short-shorts and bright red lipstick. But this sort of thing has become a daily occurrence. I am glad the police took it so seriously, but I wonder what the response would have been, had it not been a school parking lot.

Instead, he went "Oh, well you're very pretty."

Yeah but he's in a car, and has at least 50 pounds, if not even maybe 100 pounds on me. I lose a fight.

That's the point where I would have told him to go the hell away and given you a hug. See because in this scenario I'm there for you instead of pretending I'm you.

I'd guess the same with me. I just anger easy and won't stand for shit like that, whether it's happening to me, someone I know, or especially to someone I don't know.

You always think that you would do something like that. But then it happens and you're just in shock.

Also Nemmy, thank you, but it's a horrible feeling of needing a man around. :( I guess it's time to dedicate my life to self-defense.

I wish we lived in a world where men would recognize instead of ignore a person's signals to "leave me the fuck alone". :(
