constitutions

Postby Pope Joan » Sat Sep 19, 2009 2:40 am

America just celebrated the 222nd anniversary of her constitution.

Does your nation have a constitution?

Is it written or unwritten?

Do you support it? What would you like to change?

Maryland, Kentucky and California have never endorsed the 14th Amendment, which provides for "equal protection of the laws". A recent attempt was made in Maryland to endorse the Amendment, but it failed.

http://www.time.com/time/magazine/artic ... 84,00.html

Is a constitution less binding if it fails to have universal support from member states?

Most informed people agree that England has an unwritten constitution which by and large does well.

The German constitution is a joke. First of all: it is not even called a Verfassung (consitution) but Grundgesetz (basic law). Second: it is temporary. Yes, seriously. Look at §146 of it. The Grundgesetz was supposed to last until reunification but no one ever thought that it might be time to give the country a real constitution. In a book, this last article is even used to attempt to return Germany to a constitutional monarchy. :)

So while it has some good things in it, it feels very temporary to me. Not really the solid base you want your country to stand on.

Well, at least it would be a constitutional monarchy!

In the book "Ein König für Deutschland", the argument was that the old dynasties failed to protect the people and thus voided their rights to the throne, so the school teacher Simon König was the candidate of the Volksbewegung zur Wiedereinführung der Monarchie (people's movement for the re-establishment of monarchy). His argument was: "Someone has to do it." :)

Point. So... find enough supporters (the majority of them German), found the VWM, get enough support signatures in the different Länder to participate in the federal election 2013, elect the Land lists of candidates, and get either >2/3 of the votes, or find a coalition which agrees on changing the constitution. :ugeek:

The constitution of Finland has mostly stuff about rights, form of gorvernment, legislation, international relations, administration of justice and national defence.

If anybody wants to read it: here's a PDF.

The UK has an unwritten constitution.

Not technically true, its uncodified, ie not in a single document, but large parts of it are written. Statute law forms a primary base of it and that is definately written. Most scholars accept EU treaties and law to be part of the constitution aswell and they are written. The conventions and common law are however unwritten.

We have one. A new one. Ten years old.

So, we have a constitution was was designed written and approved in 1999. However, it has been reformed and ammended already. And there are many, many suits regarding points and articles that seem to be too open to many interpretations.
