I don't need to read the source to know that reversal of the burden of proof is in 99% of the cases, unfair. Especially when constitutional right of due process establishes as a corollary that conviction must happen when guilt is proven.

I agree with the majority here, innocent until proven guilty is a far better than what that article suggests...

I've heard America has the highest % of false rape claims too.

I think mostly sarcasm.

I have, however, caught people in the act of trying to define consent in terms of a retroactive determination here on NSG and called them out for it; and retroactive determination of consent is a very real problem. The idea that women will wake up, regret having sex with a man, and then determine retroactively that they must have been raped is, unfortunately, an all-too-real hazard, especially with the way that rape is described to young women.

That's because the 1.5% figure has absolutely no relevance to reality. It's a political fabrication, essentially.

Some of the variation is because the standard of "false" migrates around. Feminist activists have primarily assumed that all rape accusations are true unless proven false to a very high standard of evidence. Those reacting have responded by assuming all rape accusations outside of those proven true are false (which is where you get the 90%).

Those using the standard that there's good reason to conclude that the accusation is false, such as Kanin in his 1994 study, have found figures in a more moderate and reasonable range. Kanin used a fairly high standard for falsehood - he was essentially measuring the recantation rate, the rate at which those making an accusation of rape recant their accusation - and for any other accusation, it would be accepted as a lower bound on the rate of actual falsehood.

The current system is bad enough as it is without this.

Women can scream rape and the man will go to jail 90% of the time, because for some reason, the woman's word is always ultimate truth. There's several stories about this, such as the woman who gave a blowjob to a man, the man didn't do what she asked him (the woman cheated on him before), she accused him of rape and took him to court. If he had not unwittingly recorded the session, he would have gone to court. It's ridiculous how the man needed video evidence to not get sent to jail - And it all started just because the man wouldn't help the woman get an abortion from a previous relationship (She didn't want her family to know)

The current system is biased enough towards women.

Nope.

But then, which do you expect to be more common? Accusing, and then recanting false, or accusing, and then failing to recant even though your accusation is false?

There are clear motives women have for wanting to make a false accusation of rape, which Kanin classifies in three main categories. Creation of an alibi to defend her own reputation (generally after having sex with someone and wanting to account for it), revenge (generally in response to rejection), and attention/sympathy seeking (generally by claiming to be raped without identifying a suspect known to them).

Something I know full well will never happen? How do I know that? In the UK, possessing a penis is required for rape to be rape. If you do not possess such an organ, it CANNOT be rape. Even with a dildo, a female is incapable of rape.

Further, they have already come dangerously close to shifting the burden of proof to the accused. How do you prove you didn't do something? How do you prove someone consented? By asking her to sign a contract before engaging in sexual activity? I know enough about women to know that a turned on woman will be immediately turned off by showing her such distrust.
