I agree that someone being falsely accused of something sucks. I know a man who was falsely accused of sexual harassment. While he was found not guilty (he wasn't even at work that day to "corner her in the break room and proposition her") his co-workers still look at him differently. While that sucks for him, he would NEVER compare it to being raped. Possibly though because he's married to someone who has been raped and he knows the difference.

going back to the original post that i was responding to...

being figuratively raped can never be the same as being literally raped.

being verbally beaten up can never be the same as being literally beaten up.

having your dignity stolen can never be the same as having your car stolen.

to suggest that the penalty for falsely charging rape should be the same as the penalty for committing rape because the person who is falsely accused is being "fucked" is to deny reality. it is a not-so-clever use of words to deny the horror of rape.

no one in this thread suggested that it should be open season on men, that filing false charges shouldnt be punished, that no woman could ever be so foolish as to committ this particular crime, that it is so trivial a crime that there should be no penalty for it.

it should be punished the same way that any other false accusation is punished.

I know. I just said it's in no way comparable. I know you're not intending this at all, but it comes of as any acknowledgment that being falsely accused can wreak havoc with someone's life in a way that can be irreparable means that I'm comparing it to actually being raped, even if I explicity said it wasn't comparable.

what I wonder is should we punish someone make a false claim, about a woman making a false claim of rape.

The woman needs to make some sort of public apology, it's what happens.

Besides we already have a system that deals with false rape claims.
It is called filing a false police report.
The reason so few are pursued is the same standard of evidence that protected the person accused of rape also protects the one making the accusation, when investigated for a false police report.

Yes, I do understand that being accused of rape--despite all of the negative and often irreparable effects it can have one one's life--is in no way comparable to actually being raped. I stated as much at the beginning of my post.

That said, it seems like if I claim that being accused of rape sucks, it's somehow instead seen as an attempt to equate the two, even I explicitly said that it wasn't.

Hiddenrun's having the same problem -- he never said a drunk woman deserved to get raped. He came close with that "like every woman drunk off her ass on Friday night" comment (or whatever it was), but the nature of his posts have sometimes been close enough to misinterpretability to have exactly that happen to them. He's off his nut with his comparison between a false allegation and actually being raped, but he should not be subjected to some of the assumptions being levied at him in this thread.

Of course, the OP question has been settled already, but this is NSG, after all. The punishment should be what it already is, and the one person in (what was Bottle's statistic?) 80,000 who will be successfully falsely accused should get a better wife, better friends and a church that practices what it preaches.

To the OP,
The rate of false reporting for rape is 2%, about the same as most other crimes. All people falsly reporting a crime should be punished. Why the focus on rape? Makes me wonder if you might be one of those guys who believes most rape reports are false and if she was wearing a short skirt or drunk she was asking for it. If this isn't so, you have my apologies.
