This is quite disgusting. She deserves absolutely no money. Obviously it was foreseen his body parts would hurt the woman. This should have just been thrown away.

So I guess they're going to have to bring his body parts in and question him huh? Ask his reasoning, and then wonder if he can get by by pleading insanity. Hopefully a lawyer will be provided too, I hear he can be the quiet type.

The woman wasn't doing anything dangerous or stupid at the time so I don't see why she should just get told that she can pay for her treatment herself. That being said, I don't know who's responsibility this is as suing a dead guy seems pretty low.

Had the dude lived his own negligence in running in front of a speeding train would have made him liable. So holding his estate liable seems like a logical extension, it just sounds silly but honestly, it works.

He ran in front of it. Whether he intentionally did it isn't important (well, it is I guess, but it's certainly not disqualifying for fault). If I cause an accident and die in it, isn't it still my fault?

Negligence.

EDIT: Seeing what The Murt wrote ... it certainly would be his fault if he had deliberately jumped in front of the train, but I think a lot of people would feel worse about suing the estate of a suicide.

Actually, criminal responsibility is personal and ceases with the death of the individual. Liability for damages, instead, carries on to the eventual heirs. So I'd say she has a point there.

It was his fault for negligence and running in front of train, so I would say women was quite justified in suing.
