Honestly, it's an intuitive thing. Citizens can't go jumping on every "criminal" that commits one of (literally) dozens of misdemeanors.

Actually a security officer can detain someone if they committed a crime and put them under citizens arrest. But I do agree that the whole thing was retarded and that the store should be boycotted because of it. I mean come on it is just a 5 dollar item and an honest mistake and she was pregnant and the state had to take her kid away. This calls for a boycott.

Speaking as a former rent-a-cop, in most states security officers do have the authority to detain subjects until full blown LEO's show up. Now, a lot of that is left to the discretion of managers, supervisors and the like. If they say "hold them and call the cops" then thats what you have to do. Is it stupid? Yes. Especially since it was over $5 and she had a small child, not to mention the baby. I see this as a black mark against the moron that made the decision to hold her. If it'd up to me (and from the other responses, if it had been any of us really) drop the lincoln note and be on your merry way. If I was a prosecutor, I would refuse to try the case. If I was the judge, I'd order a fine of $5 and the record expunged.

Maybe the pregnancy was affecting her ability to think clearly or something along those lines made it hard for her to remember as she was just trying to get something to eat in response to her body hormones? In all cases though, I don't understand why the store would not accept the money. I think she shouldve paid and maybe warned to keep careful track of any food items she eats before paying, but this is just silly.

Who the hell sits in a store office for 4 hours? Do Americans realize loss prevention officers have zero authority to detain them, and that if they so much as lay a hand on you, that you can press assault charges against them? Store security aren't cops, they have no authority to detain you. So most of all I'm sad that it even came to this, I doubt the couple could have even been arrested if they just flipped the store the bird and walked out.

Likely even if they could have gotten up, their regress was likely blocked by security officers. They can't use physical force to detain you.. You however also cannot use force to leave. So if security or some other personnel is standing at the exit to your office you're really not going anywhere, unless you're planning on being arrested for shoplifting AND assault.

I do believe that this was a little over the top of management to take such a hardline approach to $5.00 worth of goods though.

There are no Walmarts in Australia and Targets don't sell food here.

It's just that I've never seen it done before.

I have seen, and done it myself, many times especially at convenience stores or mini marts. Drink/bag of chips/hot dog specials. You are halfway through the bag of chips and the drink and maybe have finished the hot dog by the time you get to the register to pay for it.

Just need to be careful that you make sure you tell/show the clerk everything that you just noshed.

Yeah, pregnant women are all entirely irrational and governed only by emotion. Even moreso than most women, which is really saying something since most women couldn't think clearly at any time, really, and are too busy thinking only about babies and kittens and the like leaving them incapable of operating rationally.
