Since it's a US hospital -- where all the doctors assume they'll be sued eventually* -- I believe that his lawyer told the truth when he told the Beeb:

The way I understand it, and the way I understand that it is normally done, is that he had signed the contract prior to the operation that specified that the doctor had the ability to perform further surgery in the event of unforeseen consequences or something.
