Probably because he has no evidence that they're illegal immigrants, aside from the colour of their skin. Now, while that might be enough for the authorities in Alabama, the feds are a bit more reasonable(I would hope).

SCOTUS does not "amend" the Constitution. They do make crazy rulings, half the time (your choice on what's "crazy"), on what something means & if something does or doesn't apply.
