I wonder who's even actually responsible for this stuff. I would guess Monolith Productions have little say in the matter, but I'm not entirely sure if it is Warner Brothers fault, either, though it seems much more likely. I know the Tolkien people can be kind of a pain in the ass to deal with from what I've heard, so who knows. There seems to be sooo many people who have copyright over Tolkien lore stuff now.

It's likely to be the publisher WB. The devs would likely be too busy making the game to be worried about it and the Tolkein people probably don't care much since SoM isn't within the lore of the LOTR.

That's not the logic I used when I got Mass Effect and Mass Effect 2: CE on Steam ($9.99 sale for both games bundled; totally worth it).
