Murderous psycho or not, Hans is still a political figure from a foreign land, Arendelle doesn't have the right to sentence him to anything without the Southern Isle's permission. All they can do on their own is kick him out of the country and let his nation know what he did. From what the movie implied, thankfully it seemed at least like Hans' country wasn't going to let this slide.

Screwing over your trade partner is a terrible mistake in the 19th century. I doubt the Southern Isles will execute Hans, but banishment might be his fate.
