I was making the legal point that, at least in the UK, this would likely not be considered kidnap/false imprisonment as the migrants were, conceivably, free to leave the ship. When looking simply at the bare facts of the case, the migrants had somewhere that they could exit from: the fact that such an exit was hazardous to their health does not change the fact that it was an exit. I wasn't advocating that it be taken.
