[DECEASED] Most Uncourteous

Postby Shwe Tu Colony » Wed Mar 07, 2018 8:28 pm

Underlined phrases are my own comments & notes & orange words are changes from the previous draft. If just the option & its number are orange, then a whole new option has been introduced. Attempt number 2 of repealing a court ban. First one was here.

Title: Most Uncourteuos
Validity: Must not have courts
Description: Your charismatic, but dictatorial, brother has taken advantage of the nation's lack of courts to accuse a high-ranking minister, Catherine Gratwick, of stealing candy from a small child. With the defense lawyers and proper courts unavailable to prove her innocence and most of @@NAME@@ believing your brother's lies, it seems that she in quite a pickle.

Option 1: "We still have time to turn this around!" hastily shouts Johannes Robin, a previous judge, while pulling out a document. "... After your decision to abolish our courts — a ludicrous idea, might I add — I've been writing this for when you reinstate the justice system. Not only will this legal system enlighten the lot trying to kick Gratwick out, but it's far more efficient than our previous ... system through an emphasis on truly blind justice. There's no way you'd even consider abolishing this system!"
Fallout 1: the new courts blindfold everyone in the "name of blind justice"

Option 2: "I've got you now!" says your brother, breaking and rolling through a window before throwing a molotov cocktail at Johannes. "Bet you all are regretting getting rid of those courts now, eh? If Bratwick stays one more day in this nation, she'll be met with a lynch mob almost the size of @@POPULATION@@. But, if I get her position, which I won't abuse, I'll make sure that shewon't be hurt at all... I'll make this nation even better than it is now, by ensuring we'll be the ones in control, @@LEADER@@!"
Fallout 2: the brother of @@LEADER@@ is now a hated minister for his selfish policies

Option 3: "Bah! What a rude lot!" says your Minister of Warfare @@RANDOMNAME@@, putting out the fire on Johannes. "Court this! Court that! Let me be a minister! All this shoutin' is bein' a huge nuisance to everyone. Just send out the military to disperse these rebels, @@LEADER@@. Yes, we'll be accused of human rights abuses by almost everyone, but the unruly lot outside is threatening the glory of our nation and woke me up from my afternoon nap! They'll deserve whatever punishment comes their way."
Fallout 3: those that insult @@LEADER@@ are bombarded by tear gas

(must have private industry)
Option 4: You know what courts take? Money from the government!" states a businessperson, walking into the scene. "But do I have a better idea! Instead of spending the citizens' tax money on justice — and getting no benefits from it, might I add — my company can create and manage the future courts of @@NATION@@! We'll make sure every case is resolved as quick as lightning, I promise you. Just sign here." @@HE@@ then shoves a clipboard, pen, and a stack of papers into your hands.
Fallout 4: privatized courts waste most of their time on trying to sue the rivals of their owners
(is it a legal move for me to swipe this from the old one?)

The first thing that strikes me is, I am not sure if that is how having no courts work, and I am sure that is not how having courts work. Even in democratic countries, the head of government would not be tried in office. Jaywalking is rarely tried anyway.

I assume that having no courts means that once a suspect is arrested he is as good as convicted. I suggest that you have someone else besides the Leader be falsely accused. The trigger could also be overflowing prisons.

No courts mean no formal courts, so a crowd could be whipped up into a frenzy for some mob justice on someone. I will change it to not be the leader, though, & maybe throw in a Hamilton reference.

A judge? But there aren't any courts...

In nations where cares aren't banned, probably.

There are currently no issues specifically addressing jaywalking.

The no courts policy is activated by:

98.2 - police can shoot anyone they think is guilty
240.3 - no trials, a judge just locks up people he thinks are guilty.
253.2 - public opinion is all that matters
533.3 - trial by ordeal
738.2 - lex talionis
756.3 - law itself abolished
858.4 - automated computerised decisions

There's no consistent standard for what replacement system is in place, so avoid narrative assumptions of that sort. Instead, the only commonality is the absence of formal arguments for prosecution and defence, and an official body making judgements based on that.

Wouldn't it make more sense to have separate followup issues depending on what the replacement system is, rather than a one-size-fit-all? It seems like a rather important detail.

Though it wouldn't surprise me if the game fails to track it...

Sure, granularity vs simplicity, as always. We're not likely to change the existing system though. Instead, if we want specific consequences to specific choices, we can do specific consequence issues that chain from those options. If we're looking at a more generic reversal, it'd make sense to emphasise what has been lost with the ban rather than the system that replaces it.

The problem is that, depending on what the replacement is, "what has been lost" can vary.

If you have a ham-and-cheese sandwich, then banning ham, banning cheese, and banning bread will each cause you to no longer have a ham-and-cheese sandwich. However, in each case, you do still have two out of three parts of the sandwich, which, depending on your tastes, may have been the parts you were interested in anyway. (Incidentally, of those three, banning bread is the only one that NationStates doesn't currently let you do.)

Plus, aren't we always saying that followup issues should address new problems arising from the policy, rather than people just going "we don't like your decision, go back to the way things were before"?

Right, there is a narrative challenge here. But the answer here is clever storytelling, not introducing a policy for every time an issue option proposes a legal system. The game has never sought that level of tracking or granularity, and doesn't have the architecture to properly support that.

Looking at all of those possible combinations... no wait, I have an idea that might be able to fit them all, but I'll start a new issue draft because it'll be too drastically different from this one.
