Free TBR Constitutional Convention

Current Draft(Extremely Rough)

Preamble

We, the sovereign nations of the newly reformed region The Black Riders, do hereby create a constitution, to live by and obey. In creating this constitution, we understand that this region will have new life, and a chance to begin anew. We swear to ourselves, to be true to our beliefs, to protect and defend, support and assist, and develop relations within ourselves. By this unity, and by our independence, the nations of this region have set the laws of the land as follows:

Article One: Ministries
The Ministries will be divided into six offices: the Prime Minister, and the Ministries of Defense, Foreign Affairs, Intelligence, Interior, and Justice. Ministers will serve for two months. They can serve a maximum of 2 terms every 6 terms. Ministry elections will alternate.

Laws are drafted by ministries, but voted on by people.

To do this, the Ministries of Defense, Foreign Affairs, and Intelligence serve for one month the first term, while the Ministries of the Interior and Justice will serve two months every time.

The Prime Minister will act as the overseer of all other Ministries. He is to ensure that there is now slacking off, that all laws are constitutional, and is also to assist in the carrying out of laws. His election will be held every 6 months. He can only run if he meets the following criteria:
A. Must Have been in the Region for Over 90 days
B. Not a puppet
C. Has had no Affiliation with the Former Black Rider Government, or any other raider government
D. Has not had any trouble with the Justice system

Defense
The Ministry of Defense shall consist of a Minister, who is elected, who then appoints up to three advisers to aid him in his duties.

His duties include: Sustaining a small defense force, keeping all invaders out, addressing all threats accordingly, and keeping good relations with the defenders.


Justice
Justice system will be fairly simple. Juries will be chosen at random when necessary. The Ministry of Justice will have one overseer, the minister, and 7 judges, who are to be appointed by the Minister. If any Judge is found to be biased, they shall be relieved of their position.

Depending on the law broken, a max penalty will be established. Treason is at least a month banishment followed by two months parole, with no chance of ever running for office again, at max permanent banishment.

Trial length cannot exceed more than 4 week to ensure a speedy and fair trial.

Article 2: Delegacy
The position of delegate will NOT be elected , due to the fact that it could cause serious security problems.

The delegate will only enforce laws when necessary. He cannot use his powers to influence any politics in the region, if that were to happen, depending on the severity, he would either be given a warning, be forced to resign, or the defense force can be used in the event the delegate refuses or becomes too powerful.

In the event this happens, or the delegate can no longer fulfill his duties, the new delegate will be carefully chosen from a list of the most impartial, influential, senior members of the region and voted upon in a special election. This is the only case where the Delegate shall be elected by the people. No exceptions.

Article 3: Voting and the People's Senate

Voting

New nations to the region, recently created or ancient, have a 30 day period to wait before voting.

All nations have to register any puppets, if discovered that they commit fraud by voting with a puppet, they cannot vote in any elections for a time period to be decided by the minister of justice.

The People's Senate
For too long, the people of The Black Raiders have gone without a say in their own government. No more. The People's Senate is just as it sounds, a senate run by the people. Not just the proud few who are elected, everyone. They vote on all laws, can act as a jury if needed, and even have to ratify this document. To be a member, you have to meet the following criteria:
1. Be a Resident of the Region for More than 30 Days
2. Not a Puppet
3. Not have had privileges revoked by the courts
4. Not a member of any Ministry at the time of the election or voting of a bill

Any and all ideas are welcome. What we are avoiding are any legislative bodies, it will be a true democracy, all people vote on the laws. Not just an elected few.

Laws can be proposed by anyone. If the majority of the region likes it, it goes in the law book. Else, it is thrown out.

That would mean so many laws to go through. They can draft them, and propose them to the appropriate ministry, but not go directly. Sorry for not explaining it the best.

You'll drive the region through the ground, let it CTE, some raider or Defender org will refound it, and it will be forever a memorial or trophy. Like DEN was for the longest time.

It would be kind of amazing if they actually erect a constitutional government over there and keep enough momentum that the old guard have to start calling themselves "The Real Black Riders."
