Made some minor wording changes here and there. Nothing major at all, just made it more concise.

Restructure to mandate with exceptions format. Should be one clause.

Reduced to one clause and two sub-clauses. Just combined 2 and 3 into 1(b).

    b. An organisation may have criminal penalties attached for association with it on the basis that it actively undermines national security, directs its members to violate national criminal law, includes the commission of crimes among its goals or activities, or spreads, or intends to spread, a message of hate directed toward a specific group.

"Ambassador, per clause b, how do we determine which organizations undermine national security? Can a government crack down on political opponents and claim that they "undermine national security"? What if a nation deemed it a crime to carry cats and cracks down on groups that do carry cats, say cat pet groups? What if said group was an anti-corruption lobby and directs a "message of hate" towards say corrupt politicians?

Wouldn't some of the provisions of this law simply undermine its intentions and goals?

We can also see clause a being abused for example for transphobic and homophobic reasons, such as "women-only" organizations refusing to allow transgender women."

OOC: Single-party regimes, under Marxism-Leninism and etc. are justified under the concept of vanguardism. This was the same framework used by Marxist-Leninist regimes to outlaw opposition parties. So, yes, abolishing one party regimes would violate the ideological ban.

Slavery is justified under the concept of natural slavery. This was the same framework used by the Confederate regime (and also Greek city states) to justify their enslavement of blacks and captured foreigners. So, yes, abolishing slavery would violate the ideological ban. Oh wait, it doesn't.

'To hold that mere recognition of a concept that a nation is ideologically opposed to is insufficient to warrant application of the rule'. Patent Recognition Treaty [2017] GAS 4. This proposal 'does not prohibit the existence of absolute monarchies nor any other type of dictatorship, autocracy, authoritarianism, despotism, or tyranny'. Proposals 'may place restrictions upon such forms of government but the General Assembly is capable of chipping away at certain aspects of any given type of government'. The Rule of Law (2014) 1 IAM 29. Similarly, banning other parties is not an ideology in the same way corruption is not an ideology. “If we regard the last clause, we’re uneasy with the suppression of freedom of speech that could take place as a result of this resolution, and feel that the image of the World Assembly may be tainted in the eyes of our general populace, even if we ourselves did not choose to levy criminal penalties on such speech, the fact that we would receive WA backing to do so is very problematic.

Our final concern is the vague wording of the last clause; this bill shall not bear the political weight one could hope it to do, for nations can abuse the indeterminate excuse of national security and hate speech as a loophole in the legislation, allowing nations to continue their suppression of said groups, and shall thus, theoretically, defend freedom of association just as much as it shall improve the lives of ordinary citizens, which, to summarize: It shall not.

In short: The Free State votes against this proposal due to its vague wording and ineffectiveness. We would, however, like to make it abundantly clear that the nation values ambassador Avi Rosenborg’s good intention, and we would like to earnestly congratulate him on his electoral success thusfar.”

North Supreria has the same concerns as the ambassador of Vrijstaat Limburg and we are not convinced that the last clause will prevent abuse and we are concerned that the current proposal will not achieve its original goal.

With all due respect, we consider it to be underdeveloped and vague in ways that would only benefit authoritarianism, which, we believe, is clearly not the aim of this proposal. It's a byproduct of unfortunate wording that will solidify our vote against."

Doesn't this mean I can label any group I want a threat to national security and still arrest people in them? Just seems like an easy way to keep tabs on everybody. Easy yes from me.

Against at least we either have a clearer wording than "hate towards a specific group" as this is too vague and ineffective; A repressive regime will simply ignore this legislation and call anything that goes against anything "hate" as it is not unreasonable that one portesting corruption would necessarily need to be critical and thereby does, in fact, express "hate". I worry that this will only encourage the obfuscation of corruption

If the idea is that it is better than not having it at all, [b]then I propose we drop the "may" from clause b and rework it so that it is eith exception rather than expressly allowed
, then we must discuss what a hate group is, what elements create them etc etc and define other legislation. We cant just ban "hate"; we have to think about the details of what we were inferring when we say hate, otherwise its an issue of when does a pile become a single grain.

Also, I believe that no matter if a group is hateful, I personally believe that this proposal is underpinned by an overestimation of such a maladapted group's rationality; as they may truly believe in whwt they espouse, some of them may believe that it would therefore win out over other beliefs, especially with for example certain "race realists", who want segregation that they believe would benefit even those they fear or hate. We have to take care that we don't turn them into martyrs. They might simply just out themselves. Something such as education, lack if exposure, or mental health must be broken first for someone to be part of a hate group. This doesnt address any of the roots of them probably and would expressly allow certain nations to target groups provided another specific group is being criticised by them and might instead cuase rhem to grow, as they are used to being underground. So why is it worded expressly as a may?

I believe we are confusing organization of crime for organization of a group worth being watchful for that may or may not commit crimes pending that other things happen or not.
They out themselves, so why stop that? That's just sweeping it under the rug. Let people see how much of them feel a certain way, else there will not be progress.

Of course, this is all hinges on the use of the word "may". I still think we might be able to address this issue, but not in this particular way if such is the intent of this legislation

The Principality of Remlasia:

  • believes the objects of the Resolution at Vote are not clear (freedom of assembly is already guaranted by World Assembly regulation);
  • believes member states can disregard the objects of Article 1(a) of the Resolution at Vote by virtue of Article 1(b) of the Resolution at Vote;
  • notes that the definition of expressions such as "hate" are not defined;
  • shall therefore regretably be voting AGAINST this proposal.

Except from Todays Questions for POTUS:

"1. Is the President aware of the current resolution begin voted on in the World Assembly, and if they are aware of it how will they be advising our stalwart ambassador to vote?

President Josiah Bartlett: I am certainly aware of the resolution now at vote in the World Assembly, and I can assure the Right Honorable Senator from New Jersey I have advised the stalwart and slightly Scotch soaked Ambassador to vote against it for the simple reason that we have no real idea what it says. However, I can also assure the senator that we are reasonably sure that whatever the hell it does say is already covered by the provisions of our Charter of Rights that no real change to the USP code will be needed when the frilly title causes the toothless thing to pass."

Blatant disregard of civil rights

Postby Ardua » Thu Apr 15, 2021 8:14 pm

I must point out the blatant disregard for civil rights in this proposal. A government can not in any circumstances bring up criminal charges against an organization that merely intends to do something. Intentions are not actions. If we begin to arrest everyone who intends to commit a crime, you also arrest all those who then think better of the decision.

There are also points against freedom of speech. Freedom of speech and expression allows those to speak their mind regardless of their opinion. One can not be arrested for hating another. They can only be arrested for promoting or committing violence. This is a distinction that must be made before I can vote for this resolution, or even follow it if passed.

I wish people would understand my problem with clause b. Most of those I've seen so far arguing against are conservative. I just don't think hate is something that can be easily defined and that this is childish logic as written.

When we say *may*, we expressly allow something. Yet, I haven't seen any explanation how we are defining hate nor how, using the broader definition where we say "yeah well its never good to just be mean" and talk about mud-slinging campaigns being bad for society or whatever, we neglect that if your campaigning against something, or even for something, rhis necessitates that you dislike something ans are encouraging others to dislike that thing.

This isnt good legislation and when it inevitable paces and if clause b is not repealed, then screw it; maybe I'll prove it by turning my nation into what you guys seem to be forgetting about.

Freedom Of Association was passed 10,882 votes to 4,209.

It appears that the title of this thread was never amended to reflect the capitalisation of the second "o" in the title... not ideal but also not as bad as the fact that the title for the formerly at-vote Right to Farm thread from 2019 continues to refer to a proposal called Freedom to Farm, to BC's credit :P

Not too worried about it lol. I didn't even realize I had capitalized the T in "To".

As for the rest of you, I look forward to the repeal attempts, I just caution you that I sincerely hope you'll make something better if you try to beat that drum.
Then save me, or the passed day will shine…
