“I’m unsure exactly what scenarios you are envisioning that would be prohibited under clause 2b. Why would any business harm its customers, given those will be the ones giving them a source of income?”
Hello! I’m a GAer and NS Roleplayer from the United Kingdom.
My pronouns are he/him.
Any posts that I make as GenSec will be clearly marked as such and OOC. Conversely, my IC ambassador in the General Assembly is Ambassador Fortier. I’m always happy to discuss ideas about proposals, particularly if grammar or wording are in issue. I am also Executive Deputy Minister for the WA Ministry of TNP.
Kenmoria is an illiberal yet democratic nation pursuing the goals of communism in a semi-effective fashion. It has a very broad diplomatic presence despite being economically developing, mainly to seek help in recovering from the effect of a recent civil war. Read the factbook here for more information; perhaps, I will eventually finish it.

“I think then it makes more sense for the clause to read ‘any individual’, since it would make more sense for a business to target its competitors’ user base. Also, perhaps restrict the ability of governments, as well as businesses, to use spyware?”

"We will work on that"

Edit:"We have decided against restricting governments from using spyware as it is an issue best left for another proposal"

OOC: Have you made sure that this doesn't run afoul of the network defence (I forget exact name, but fairly sure those words were in the title) resolution, or any resolution in existence that requires people's data to be kept for the various purposes of the resolutions in existence?

Isn't the whole point of this resolution is to protect privacy? So what is the point of this clause? To remind us the very purpose we are discussing it??

"If one wishes to enact such laws, they'll do it without someone else's encouragement. And we can simply ratify(accept or whatever) your resolution. If your resolution doesn't fit standards you wish to implement, then why should we waste our time on approving it if the problem won't be solved fully and we'd have to enact extra laws?"

Nearly all the measures in the proposal apply solely to businesses, a term that isn't defined in the text. This creates a lot of vagueness about what is and isn't a business and doesn't regulate data processing by government agencies, individuals, NGOs and (presumably) non-profits. That means that any business can create a non-profit subsidiary or appoint an individual to process data for them, thereby completely bypassing the regulations.

A business is a commonly used word, here's a definition you can find on Google:

2.

(OOC: Google’s automatic definitions alone have seven different meanings, granted that some of them are implausible like a group of ferrets. However, a business has a more specialised set of definitions in legal contexts. It can be used solely to refer to the limited liability arrangements, and the business as an entity distinct from a natural person. Alternatively, it could be used to refer to any of a: sole trader, partnership, PLC, limited liability company, state-run corporation, or a few other things.)

OOC:I can't believe I didn't remember to define what a business is, and over a period of a month, no one else noticed that error. I would love to fix this issue, but I'm going to have to delete the current proposal and post it again and do another WA campaign which might annoy people a lot as this will be the 3rd time.
