I am against this proposal on the basis that its premise is entirely flawed.

The targeted resolution does not prohibit the establishment of an International Criminal Court in any way. It merely prohibits such a court from blocking the claims of member nations to hold Universal Jurisdiction.

The remaining portions of this resolution are better phrased as an argument in favor of extradition than they are as an argument against Universal Jurisdiction.

Waffia will vote against this repeal because

  • the lack of a requirement in the target resolution for nations to provide prosecutors with information they may have does not warrant a repeal; instead, a new resolution could be created that requires this without contradicting the target resolution;
  • the assertion that "[section 7 of the target resolution] prohibits the Assembly from establishing an international court" is simply untrue, as has been noted before;
  • the author has not shown willingness to work towards a resolution to replace the target resolution, which may result in a loss of the ability of universal jurisdiction for an undetermined amount of time even though this is not the stated purpose of the repeal.

The ability to challenge the legality of a proposal is a part of the process and was done as openly as the rest of the processs. Just because it was recognized as an illegal by the secretariat on review, does not mean it was undemocratict. Democracy by itself is nothing more but two wolves and a lamb decinding what's for lunch. A well ordered Democracy is a well educated lamb contesting the results.

"Repeal "On Universal Jurisdiction"" was discarded by the WA for rule violations after garnering 14,483 votes in favor and 1,444 votes against.

The Apparat is suspending its membership in the General Assembly, along with all the rights and responsibilities thereof, until further notice. The Triumvirate feels it is untenable to impose international laws which run counter to Xanthalian sensibilities when those laws are opposed even by the Assembly itself- upheld only by an unaccountable Secretariat which has allowed itself to be made a tool of hacks and hucksters. The resumption of Xanthal's normal WA status is not contingent on any set criteria, but the repeal of GARs 312 and 443 will be considered in a most favorable light.
