Regarding Travel
A resolution to improve worldwide human and civil rights.

Description: The General Assembly,

RECOGNISING that international travel can have positive effects, both socially and economically, on businesses and citizens of a nation, as well as on the nation itself,

CONCERNED that many nations have unreasonable restrictions regarding the international travel of their citizens,

DEFINING the following:

a) The nation of origin as the member state that the individual is ordinarily resident of,
b) The host nation as the member state that the individual is present in but is not ordinarily resident of,
c) The intended nation as the nation that the individual is attempting to travel to,


Hereby,

AFFIRMS that nothing in this resolution prohibits individual member states from setting the criteria regarding the entry and residency of their state;

MANDATES that individuals abide by any such criteria if they wish to gain entry to the intended nation;

ALLOWS individuals to leave their nation of origin, free of duress and reprisal, in order to visit and/or reside in another nation;

FORBIDS a member state from refusing to allow an individual to return to their nation of origin;

HOWEVER PERMITS the restriction of travel when any, or all, of the following criteria are true:

a) The host nation or the nation of origin has probable cause to believe that the individual has committed a crime or is travelling for the purpose of committing a crime,
b) The individual does not present the correct, valid documentation pertaining to their identity,
c) The individual is at a significant risk of spreading a infectious agent which could be severely harmful to the intended nation,
d) Any other valid restrictions granted in extant World Assembly law;


DIRECTS that no nation may criminalise the attempted travel out of the country, except for when the above criteria are true and/or the individual is obliged, as per consenting duress-free, to a reasonable contract explicitly forbidding such;

CONFIRMS that in the instance a host nation is at war with a nation of origin, any non-combatant individual wishing to return to their nation of origin will be free to do so unless any, or all, of the previously mentioned criteria are true;

ALLOWS member states to put in place reasonable security protocols in order to guarantee the safety of those travelling.

Hereby,

DEFINES the following:

a) The nation of origin as the member state that the individual is ordinarily resident of,
b) The host nation as the member state that the individual is not ordinarily resident of,
c) The intended nation as the nation that the individual is attempting to travel to;


ALLOWS individuals to leave their nation of origin, free of duress and reprisal, in order to visit and/or reside in another nation;

FORBIDS a member state from refusing to allow an individuals to return to their nation of origin;

ALLOWS for the restriction of travel in both cases when any, or all, of the following criteria are true:

a) The host nation or the nation of origin has probable cause to believe that the individual has committed a crime or is travelling for the purpose of committing a crime,
b) The individual does not possess the correct documentation pertaining to their identity,

HOWEVER ALLOWS an exception to the above in the case of an individual committing an act that is deemed illegal by an existing WA resolution;

ALLOWS member states to put in place reasonable security protocols in order to guarantee the safety of those travelling;

CLARIFIES that the issue of entry of unaccompanied minors shall be the decision of the intended nation determined by individual member states.

FURTHER MANDATES that no nation may criminalise the attempted travel out of the country, except for when the above criteria are true and/or the individual is obliged, as per consenting duress-free, to a contract forbidding such, or unless required, encouraged or allowed by any resolution to do so under special circumstances;

a) The nation of origin as the member state that the individual is an ordinary resident of,
b) The host nation as the member state that the individual is not an ordinary resident of;


ALLOWS individuals to leave their nation of origin, free of duress, in order to visit and/or reside in another nation;

FORBIDS a member state from refusing to allow individuals to return to their nation of origin;

ALLOWS for the restriction of travel in both cases when any, or all, of the following criteria are true:

a) The host nation or the nation of origin has probable cause to believe that the individual has committed a crime,

FURTHER MANDATES that no nation may criminalise the attempted travel out of the country, except for when the above criteria are true and/or the individual is obliged, as per consenting duress-free, to a contract forbidding such;

OOC: Ok, so I added the issue of those under the ago of majority just in case it came up. I'm loath to include the whole security protocols article in it's current wording, as I feel it's a massive loophole. I'm also open to changing the preamble. Actually, I want to change the preamble. I don't like it. Other clauses will be considered too.

I'll do a new draft every day or so if needed. In between new drafts, I'll strike out removed clauses/pieces and add in new clauses/pieces.

Add. 31.1.11 Not too keen on keeping the clause identified thusly: **** words ****. Thoughts?

I think it is well written and promotes the spirit of friendship. Though I tend to favor letting member states decided their own rules for travel, I also think there needs to be some basic rights secured and granted. Not to much the criteria is vague enough to be used as a loophole should a nation deem it necessary (something I especially like).

We are strongly against this micromanagement of travel. Member nations are capable enough to decide who comes in or doesn't come in their land.

To an extent, I would normally agree. However from what I can tell this resolution just makes sure people who leave, will not be denied entry back unless they fit the criteria restricting them so.

It allows individuals to return to the country of origin, and it also ensures that people have the right to leave their country of origin, as long as another nation will take them. I like this idea, though I suggest modifying this clause:

First, there's an extraneous a in there (is a suspected). Second, and more important, it only requires evidence that the individual is suspected (by anyone) of committing a crime. All that would be required is for one (any) person to say that they suspect the individual of committing some crime, and the host country would be able to deny return travel. Perhaps something like:

a) The host nation has probable cause to believe that the individual has committed a crime,


would be more appropriate.

Have you reviewed the Standardised Passport Act? I think there might be some possible duplication/etc. given the similar themes.

(I don't have the time right now to do a full-on legality check, but I'm not positive that you were aware of that resolution and took it into account with your drafting.)

As I mentioned to the honoured ambassador for Sanctaria in private, there is a particular concern that I wish this resolution to deal with;

FURTHER FORBIDS nations from bringing criminal charges against citizens who, while visiting or residing in a host country, commit acts which are legal in the host country but illegal in the country of origin,


My concerns on this point were the reason I originally opposed On Abortion; I wished there to be a clause preventing states that still had non-protected abortions from persecuting women who traveled to more liberal nations to receive abortions that would be illegal in their host country.

However, I feel this concern extends far beyond that scenario and is worth including in this proposal.

I did have a look through it and the only concern I have is the following:

AFFIRMS that any national of a member state, carrying a valid passport and visa cannot be denied entry to a nation, except where either the security of that nation is at stake, for reasons of medical quarantine, where there is reason to believe the terms of the visa are likely to be violated or if there is reason to believe the visa was obtained fraudulently,


It could clash with:

FORBIDS a nation from refusing to allow individuals to return to their country of origin unless any of the following criteria are true:

a) The host nation has probable cause to believe that the individual has committed a crime,
b) The individual does not possess the correct documentation pertaining to their identity,

Now from my point of view, it doesn't violate that clause, but does it duplicate it? The first clause is from the point of view that if you have valid documentation, and that's all you need, you can't be denied entry unless these things are happening, whereas my clause expands on this and say you can't deny entry in any case, except these.

Could I have some clarification?

I could support this:

I've underlined something which you may have missed. The criteria is:

One would assume that a soldier doesn't carry his passport, firstly. Secondly participating in a war against a nation could be breaking that nation's laws and thirdly, if they're seriously wounded then I'm sure clause c) would come into effect. As long as the nation abides by the POW accord otherwise, this proposal shouldn't violate it.

I'd rather not, Ambassador. I feel that work would be outside of this proposal's remit. This is about the freedom to both leave your own country as well as the freedom to go to another, assuming they'll allow you entry. Whether they'll allow you to work or not may fall outside the scope of this proposal.

Actually, no, you are wrong. Assuming and inferring does not make for effective legislation. Permitting, even requiring, travel between enemy nations during wartime is a silly precedent to make. Also, assuming that "if this this and this happen, then we aren't required to do this" is not a good means of ensuring compliance.

One more thing, soldiers do not need passports. Military ID is considered sufficient ID.

By only assuming things, you have effectively released virtually all POW's in every war because according to this draft they cannot legally be held against their will.

Says who? The Standardised Passport Act doesn't mention Military IDs. Unless your Military IDs state that "Soldier X" is a citizen of your country, plus has all the other details. Something that I don't think a soldier, being parachuted into enemy terrain is going to carry. But if they do, ok, I'll take your point for now.

I'm merely extending on something already written into the statute books. If the Ambassador has a problem with this, he should repeal the SPA and then come back to me and we'll discuss something.

I would insert the word civilian, instead of individual, but I'm afraid that may violate the CoCR and discrimination based on employment, or whatever. If you could advise me on this we could work something out.

We have found nothing in the SPA concerning POW's and military identification. perhaps you could show us just which section we missed?

Your proposal, on the other hand, does indeed spcifically state that person are permitted to leave at will during time of war, without making any exceptions for POW's, just a blanket permission slip.

See the bolded section. Yes, before you suggest otherwise, we can read the next few words and our proposal already has that covered:

FORBIDS a nation from refusing to allow individuals to return to their country of origin unless any of the following criteria are true:

a) The host nation has probable cause to believe that the individual has committed a crime,
b) The individual does not possess the correct documentation pertaining to their identity,
c) That immediate travel would be seriously detrimental to the health of an individual, as determined by a certified medical doctor from either the host country or country of origin;


AFFIRMS that in the instance the host country is at war with a country of origin, any individual wishing to return to their country of origin will be free to do so, unless the above criteria are true;


The two sections that the Ambassador has a problem with in my proposal mirror the section in the already existing legislation.

Fine, you underlined the "crime" thing. Which has nothing to do with POW's. They are not prisoners under criminal law, but as enemy combatants. Being an enemy combatant is not a crime. So, either make an exception for POW's or admit you have no intention to do so, rather than continueing to argue in circles.

I was under the impression being at war with a nation would be a crime in that nation, but if you say that this is not so, I'll accept.

As I've stated, I can change the wording of the clause from "individual" to " non-combatant", and I suppose I can say that it's a compelling practical purpose under the CoCR - it is, these people are civilians and cannot defend themselevs against belligerants, or whatever way you'd like to phrase it.

Would that satisfy the Ambassador's qualms?
