第　一　條 中華民國軍人駐守外國而犯本條之罪，當事人為該國或外國人時，適用本軍律處罰之。其為外國人舉發者亦同。
第　二　條 不適用本軍律之案件，適用陸海空軍刑律處罰之。
第　三　條 犯左列罪者處死刑：

第　九　條 本軍律自公布日施行。

Article 1. This code shall apply to all military personnel stationed abroad, where the interested party shall be a national of that nation or a third nation; this code shall apply equally if the criminal act was reported by a foreigner.
Article 2. Criminal cases where this code does not apply shall be tried under the Land, Sea, and Air Forces Penal Code.
Article 3. The following crimes shall be punished by the death penalty:

1. murder
2. manslaughter
3. grievous injury resulting in death
4. counselling to suicide
5. grievous injury
6. injury not grievous
7. rape
8. enslavement
9. deprivation of liberty
10. coercion
11. robbery
12. burglary
13. larceny
14. fraud
15. arson
16. destruction of reservoirs or riverbanks
17. abduction to ransom
18. abduction by force
19. abduction not by force
20. transportation of the abducted abroad
21. embezzlement
22. perjury
23. use of narcotics
24. medium to prostitution
25. falsification of currency
26. falsification of negotiable monetary instruments
27. tomb raiding
28. libel
29. piracy on the high seas
30. threatening to commit a crime

Article 4. The following behaviour shall be punished by death:

1. defamation against the local government
2. destruction of public property, buildings, and transport vehicles
3. illegal entry into private and public buildings
4. public drunkenness leading to behaviour unbecoming
5. unreasonable noise generation during night
6. spreading of rumours leading to panic
7. causing strikes in labourers, or merchants to abandon the market, or students to refuse to attend classes
8. causing riots
9. counselling locals to commit a crime
10. flirting with females
11. failing to drive a vehicle safely
12. obstruction of an administrative official
13. prostitution
14. spreading epidemics
15. engrossment
16. loaning with illegal interest rates
17. selling of private tobacco, alcohol, and salt and other restricted supplies
18. issuing of bills and receipts not exchanged as negotiated
19. negotiating falsified currency
20. other behaviour disruptive to civilian life.

Article 5. Attempts and conspiracies to commit the crimes and acts enumerated in Articles 3 and 4 shall be punished.
Article 6. In case where acts against Articles 3 and 4 are a result of a superior's commands, the superior shall be held liable to the same offence; the principal shall receive remission.
Article 7. Execution of penalties may be made public or entrusted to local government agencies.
Article 8. Military judges that pronounce judgments according to this Code, where subsequently there is discovered any error in fact or law, shall be punished by death. Military prosecutors who are privy of such errors shall be punished likewise.
Article 9. This Code shall enter into effect upon promulgation.

第七條　 國防部部長如缺位或因故不能行使職權，由國防部副部長代行之。如副部長亦缺位或因故不能行使職權，由政務次長代行之。如政務次長有二人以上，由行政院院長指定其中一人代行之，並應提出於行政院會議。如行政院會議不同意，應由行政院指定常務次長代行之。
第八條　 參謀總長如缺位或因故不能行使職權，代行方式由國防部以命令定之。
第九條　 部隊之員額及組織準則，由國防部以命令定之。
部隊之員額及組織遇有變更，應由參謀總長奉國防部核准後執行之。
第十條　 軍人之招募、俸給、福利、階級、銓敘、任用、退伍，軍眷屬之福利及撫卹，及軍事學校事宜，以法律定之。
第十一條　 軍刑法以法律定之。但軍隊之紀律規則，由國防部以命令定之。
因觸犯紀律規則而裁處之懲戒，不得超過刑法之最低刑度。
第十二條　 軍法官應獨立行使職權。
第十三條　 國防部遇有警急情形，經各責任機關之同意，得調用中央交通警察、邊防部隊、海巡部隊、海關人員、國境管制人員、省保安部隊、省警察、縣警察等武力人員，達成國防之目的。
前項情形，應立即呈報行政院院長，並由院長召開行政院會議。行政院會議如不同意，所調用之人員應即歸還各該責任機關。行政院會議如不能即時召開，行政院院長得先行停止國防部之行為。
執行業務所必要之資源，應由國防部配給之。所發生之結果，應由國防部負其責任。憲法第九條之規定，適用之。



Presidential Proclamation W.T. No. 1289

The Legislative Yuan has passed an amendment to the National Defence Organization Act and submitted for promulgation, and it is hereby accordingly promulgated.

Article 1. The national defence of the Republic of China shall be organized as herein provided.
Article 2. Citizens of the Republic of China shall have the obligation to participate in national defence as provided by law.
Article 3. The President shall be the commander-in-chief of the armed forces.
Article 4. The Executive Yuan shall make defence policy and deliver it to the Ministry of Defence for implementation.
Article 5. The Secretary of State for Defence, in accordance with defence policy, shall direct the Chief of Defence Staff to command the armed forces.
Article 6. The Minister of State and Under-Secretaries of State in the Ministry of Defence shall assist the Secretary of State for Defence as provided in the Ministry of Defence Organization Act.
Article 7. Should the Secretary of State for Defence be vacant or unable to exercise his powers due to any reason, the Minister of State shall exercise the same; should the Minister of State be vacant or unable to exercise his powers due to any reason, the Under-Secretary of State shall exercise the same. Should there be more than two Under-Secretaries of State, the President of the Executive Yuan shall designate one amongst them to exercise the same and propose this act to the Executive Yuan Council. Should the Executive Yuan Council resolve against this designation, the Executive Yuan shall designate another Under-Secretary of State or the Permanent Secretary of the Ministry of Defence.
Article 8. The Ministry of Defecne shall, by an ordinance, provide for the case of the Chief of Defence Staff being vacant or unable to exercise his powers.
Article 9. The principles of number and organization of units of the armed forces shall be determined by an ordinance of the Ministry of Defence.
Any changes to the unit number and organization shall be implemented by the Chief of Defence Staff after obtaining the approval of the Ministry of Defence.
Article 10. The recruitment, enlistment, commission, remuneration, benefits, ranking, regulation, appointment, and retirement, the benefits and compensation of relatives of personnel, and all matters pertaining to military schools, shall be determined by legislation.
Article 11. The military penal code shall be determined by legislation. But the disciplinary rules of the armed forces shall be determined by an ordinance of the Ministry of Defence.
Punitive action as a result of breaching the disciplinary rules shall not exceed the minimum sentence in the penal code.
Article 12. Judges of courts-martial shall independently discharge their duties.
Article 13. In an emergency situation, the Ministry of Defence, subject to the approval of each responsible agency, may second the Central Transport Police, the Border Guards, the Coast Guards, the personnel of the Customs, the personnel of the Border Control Agency, the units of provincial security forces, the provincial police, and the county police, and such public forces, to achieve the objective of national defence.
Should the preceding action be taken, it shall immediately be notified to the President of the Executive Yuan, who shall then hold a meeting of the Executive Yuan Council. Should the same resolve against the actions taken by the Ministry of Defence, the same shall return all seconded personnel to their original agencies. Should the Executive Yuan Council be unable to be convened immediately, the President of the Executive Yuan shall have power to order the Ministry of Defence to cease such actions pending a meeting of the Executive Yuan Council.
Article 14. All resources required for the actions in Article 13 shall be provided by the Ministry of Defence, which shall also be responsible for any consequences occurring as a result of such action. The regulations of Article 9 of the Constitution shall apply in this case.
