Blues and Twos Act (BATA)

Preamble
The Aurentine Senate,
Recognizing the need for regulations regarding emergency lighting and sound systems such as "blue lights" and "sirens",
Hereby passes the following to law.
I. Definitions
a. Blue lights - Flashing or rotating blue lighting affixed to a motor vehicle.
b. Red Lights - Flashing or rotating red lighting affixed to a motor vehicle with the exception of lighting indicating a slowing of speed or the application of brakes on the vehicle.
c. Amber Lights - Flashing or rotating amber lighting affixed to a motor vehicle with the exception of lighting indicating a driver's intention of changing direction.
d. Emergency - Eminent threat to someone's life, property, livelihood, or anything considered by the individual person to be reasonable to be considered an emergency.
II. Usage of Blue Lights and Sirens
a. Private usage of Blue Lights and Sirens for any purpose whatsoever is hereby forbidden.
b. The Several Constabularies of Aurentina, the Aurentine National Gendarmerie, the Armed Services of Aurentina, and the National Investigation Bureau, along with any other law enforcement/policing agencies not mentioned or passed in later legislation are permitted to use blue lights and sirens on vehicles owned by the agency.
c. Blue lights and sirens are only to be used in the following cases.d. Blue Lights may be housed internally or externally.
- The attempt to stop a vehicle for violation of national and local traffic code.
- Escorts of foreign and domestic government members in the case of legitimate threat to their life.
- The pursuit of any person fleeing from law enforcement
- Response to anything considered by the individual law enforcement agent, to be a legitimate emergency.
- Miscellaneous tasks not mentioned with the permission of a Lieutenant or the equivalent thereof.
III. Usage of Red Lights and Sirens
a. Private usage of Red Lights and Sirens for any purpose whatsoever is hereby forbidden.
b. The National Fire Service inside Aurentina, local fire, ambulance services, along with organ donor transportation services are permitted to use red lights on vehicles owned by the agency.
c. Red lights are only to be used in the following cases.
- The response to any emergency calls, or situations presented to the individual agency.
- Providing support to escorts of government members in case of legitimate threat to their life.
- The transport of injured persons to hospital.
- The transport of donated organs from one location to another.
- Miscellaneous tasks not mentioned with the permission of a supervisor or the equivalent thereof.
IV. Usage of Amber Lights
a. Restricted private usage of Amber Lights is to be permitted with the stipulations stated in this bill.
b. With a permit from a local constabulary station house, the following uses are considered legitmate usage of amber lights.c. In order for any vehicle to be equipped with Amber Lights, the vehicle must individually be approved to have amber lighting on it, and must display on the request of an officer of the law the permit granted by the local constabulary.
- A slow moving vehicle driving on, or near public roads.
- Operation of construction equipment that rotates and poses a risk to anyone standing near it with injury.
- A vehicle that makes frequent stops (e.g. a bus).

Noting that the Aurentisë Televisënetwörk, as Aurentina's public broadcaster, was prohibited from carrying any form of commercial advertising by the Broadcasting Act,
Acknowledging that this clause was flawed and that advertising revenues are essential to keeping television networks profitable and financially viable,
Wishing to reduce the strain imposed by the activities of the Aurentisë Televisënetwörk on the Budget of the Aurentine Government,
The following act, to be referenced to as the First Amendment to the Broadcasting Act of 2013, is passed into law:
The clause of Section IV of the Broadcasting Act reading "ATN shall not carry any advertising, save for Public Service Announcements" is struck out and rendered null and void.

Firearms Licensing and Reasonable Restrictions Act

The Senate of the Aurentine Commonwealth,
CONCERNED at the wide range of weaponry permitted under previous legislation;
SURPRISED by this Senate's previous rather euphemistic use of the word "sensible";
NEVERTHELESS SEEKING to ensure public safety while also maintaining the rights of firearms owners to continue to use such important tools;
HEREBY ENACTS the following:SCHEDULE I: REPEALS AND ESTABLISHMENTSOn Previous Legislation
- The Improved Firearms Safety and Licencing Act shall be struck out and rendered null and void, with the exception of Articles 1C-F.
- All permits and licenses issued under the Sensible Firearms Act and Improved Firearms Safety and Licencing Act shall remain valid until their listed date of expiry or two (2) years from the ratification of this Act, whichever is sooner.
Aurentine Firearms Centre
- Permit-holders will be required to apply for a permit under this Act after their current permit expires.
- The Aurentine Firearms Centre (AFC) is hereby established within the Aurentine National Gendarmerie with the responsibility for overseeing the safe use of firearms in the Aurentine Commonwealth.
- The Aurentine Firearms Centre shall be headed by the Chief Firearms Officer (CFO), under whose authority all firearms permits shall be issued.
SCHEDULE II: FIREARMS CLASSIFICATION AND REGISTRATIONClasses of Firearms
- Firearms shall be classified under Aurentine law as Unrestricted, Restricted, and Highly Restricted.
Highly Restricted Firearms- The following shall be classified as Highly Restricted firearms:
Restricted Firearms
- Handguns with a barrel less than 105 millimetres or that are designed to discharge .25 or .32 calibre ammunition that are not used for sporting purposes as sanctioned by the International Shooting Association.
- Rifles and shotguns that have been altered by sawing, cutting or any other means, so that the barrel length is less than 457 millimetres (regardless of overall length) or the overall length is less than 660 millimetres.
- Firearms which have fully automatic fire capability, or firearms which were originally fully automatic but have been modified to discharge ammunition in an semi-automatic fashion.
- Firearms capable of discharging a dart or other object carrying electrical current or substance, including Taser Public Defender and any variant or modified version of it.
- Firearm known as SSS-1 Stinger and any similar firearm designed or of a size to fit in the palm of the hand.
- Carbines, rifles and shotguns of designs commonly known as, including any variants or modified versions of them:
- A.A. Arms AR9 semi-auto rifle and AR-9 carbine

- Any weapon that is deemed to be of similar design to any weapon classed as Highly Restricted.
- The following shall be classified as Restricted firearms:
Unrestricted Firearms
- Any handgun that is not Highly Restricted.
- Any firearm that is not Highly Restricted, has a barrel length less than 470 millimetres and is capable of discharging centre-fire ammunition in a semi-automatic fashion.
- Any firearm that can be fired when the overall length has been reduced by folding, telescoping, or other means to less than 660 millimetres.
- Unrestricted firearms shall be the only legal firearms used for hunting.
- The following shall be classified as Unrestricted firearms:
Registration of Firearms
- Any other rifle or shotgun that is not classified as Restricted or Highly Restricted.
- All Restricted and Highly Restricted firearms shall have their serial numbers and ownership information registered with the Aurentine Firearms Centre.
SCHEDULE III: FIREARMS PERMITSIneligibility for Firearms Permits
- The Chief Firearms Officer shall not issue permits to the following:
- Any former member of the Commonwealth Armed Forces, Aurentine National Gendarmerie, or any police force or law enforcement body within the Aurentine Commonwealth that has been discharged from their position as a result of committing a violent crime or similarly severe action.
- Any individual who is deemed under Aurentine law as mentally unfit, unable to manage their own affairs due to a mental illness or other condition, or whose control over their actions are severely impaired due to a mental illness or other condition.
- Any individual under the age of 18.
- Any individual who has a record of violent crime (homicide, attempted homicide, assault, sexual assault, kidnapping, robbery, and any associated crimes).
- Any individual who is not a citizen or lawful resident of the Aurentine Commonwealth.
- Any individual or business/entity that has a proven link to criminal or terrorist organizations.
Permits for Individuals- Firearms permits for individuals (hereafter referred to as "Class I permits") in the Aurentine Commonwealth shall be defined as follows:
Conditions for Granting of Class I Permits
- IU (Individual Unrestricted) Permit: Issued individual is permitted to possess and acquire unrestricted firearms.
- IR (Individual Restricted) Permit: Issued individual is permitted to possess and acquire non-restricted and restricted firearms.
- All first time applicants for Class I permits shall be subject to a 28-day waiting period.
- All applicants for Class I permits shall be required to successfully complete a firearms safety course approved by the Aurentine National Gendarmerie that explains the proper use of firearms and the legal responsibilities involved in firearms ownership.
- All applicants for Class I permits shall be required to submit to a criminal background check upon first application and for each subsequent renewal.
- All Class I permits must be renewed before the date of expiry indicated.
Class I Additional Permits- The following permits may be appended to Class IR firearms permits at the discretion of the Chief Firearms Officer:
- AT (Authorization to Transport): Individual is permitted to transfer specified Restricted or Highly Restricted firearms for the purposes specified in the permit.
- CHR-P (Carry Highly Restricted - Personal): Individual is permitted to carry a Highly Restricted or Restricted handgun on their person due to a threat assessment by a police agency clearly showing that: the life of the individual is in immediate danger, police protection is not sufficient, and the possession of a restricted firearm can reasonably be justified. Individual may only purchase or carry firearms listed on their permit.
- CHR-P-C (Carry Highly Restricted - Personal - Concealed): Same conditions as CHR-P, and individual is permitted to conceal the firearm on their person.
- CHR-W (Carry Highly Restricted - Work): Individual is permitted to carry a Highly Restricted firearm on their person due to the nature of their work for an appropriately permitted employer. This condition is only valid during said individuals working hours, and the individual may not purchase Highly Restricted firearms.
- CHR-W-C (Carry Highly Restricted - Work - Concealed): Same conditions as CHR-W, and individual is permitted to conceal the firearm on their person.
- HH (Handgun for Hunting): Individual may carry an unconcealed Restricted handgun on their person for the purposes of hunting.
- OHR-G (Own Highly Restricted - Grandfathered): Individual is permitted to own the Highly Restricted firearms listed on their permit because said firearms were owned prior to September 29, 2013.
Permits for Businesses- Firearms licenses for businesses or similar entities (hereafter refereed to as "Class B permits") in the Aurentine Commonwealth shall be defined as follows:
- BD (Business Display) Permit: Issued business is permitted to possess firearms for display or demonstration purposes (such as museums or historical interpretive sites)
- BP (Business Produce) Permit: Issued business is permitted to produce the firearms or ammunition specified on their permit.
- BB (Business Bear) Permit: Issued business is permitted to allow employees to bear firearms specified on their permit license (all employees must also hold appropriate Class I permits for the weapons they are bearing).
SCHEDULE IV: PERMIT CARDSPermit Cards
- All firearms permits shall be given in the form of a plastic card in the sizes specified by the ISO/IEC 7810 ID-1 standard, with the exception of the AT permit.
- AT permits shall be given in the form of a 60 millimetre x 92 millimetre laminated paper card.
Class I Permit Cards- Class I permit cards shall include:
Class B Permit Cards
- Photo of permit holder
- Permit holder name
- Permit holder date of birth
- Permit number
- Permit(s) issued to holder (i.e. "IU", "IR CHR-W-C", or "IR HUH")
- Firearm(s) permitted under said permit(s), if applicable
- Date of expiry
- Class B permit cards shall include:
AT Permit Card
- Name of business/entity
- Permit number
- Permit(s) issued to that business/entity
- Firearm(s) permitted under said permit(s), if applicable
- Date of expiry.
- AT permit cards shall include:
- Name and Class I permit number of transporter
- Name and Class I permit number of recipient,if applicable
- Purpose of transport
- Number and types of firearm(s) being transported (with serial numbers if applicable)
- Date of expiry.
SCHEDULE V: AMMUNITIONPurchasing of Ammunition
- Any individual purchasing ammunition shall be required to present a valid Class I permit.
- Individuals shall only be permitted to purchase ammunition for weapons they possess valid permits for.
Prohibited Ammunition- The following types of ammunition are classified as Prohibited and may not be purchased by the public:
- Handgun ammunition designed to penetrate body armor, for example: KTW and THV round, 5.7 × 28 mm (excluding sporting rounds such as SS196SR and SS197SR).
- Incendiary or explosive ammunition designed for use in or in conjunction with a magazine and does not exceed 15 mm in diameter.
- Flechette rounds
SCHEDULE VI: STORAGE AND TRANSPORTATIONStorage of Unrestricted Firearms
- When stored, Unrestricted firearms must be stored unloaded and: made inoperable with a secure locking device, or have bolt(s) or bolt-carrier(s) removed, or be securely locked in a sturdy container, cabinet or room that cannot be easily broken into.
- Exceptions to these regulations are:
Storage of Restricted and Highly Restricted Firearms
- non-restricted firearms needed for predator control can temporarily be left unlocked and operable, but they must be kept unloaded and all ammunition must be stored separately.
- in wilderness areas, non-restricted firearms can be left unlocked and/or operable, but must be left unloaded (ammunition may be kept nearby).
- Restricted and Highly Restricted firearms must be stored unloaded and either:
Storage of Ammunition
- made inoperable with a secure locking device and securely locked in a sturdy container, cabinet or room that cannot be easily broken into; or
- locked in a vault, safe or room that was built or adapted for storing these types of firearms.
- In the case of automatic firearms, the bolt(s) or bolt-carrier(s) must be removed, if removable, and stored in a separate locked room that cannot be easily broken into.
- When stored, ammunition must be kept in a location where it is not available for loading the firearm unless both the firearm and its ammunition are securely locked in appropriate containers or storage areas.
Transport of Unrestricted Firearms- Unrestricted firearms must be transported unloaded and, if left unattended in a vehicle, Unrestricted firearms must be locked in a trunk or in a similar lockable compartment of a vehicle. If such a compartment is not available the Unrestricted firearms must be placed out of sight inside the vehicle and the vehicle must be locked
Transport of Restricted and Highly Restricted Firearms
- Exceptions to this requirement of Unrestricted firearms being transported unloaded shall be made for muzzle-loading rifles which can be transported loaded between hunting sites so long as the firing cap or flint is removed.
- Any individual or business transporting Restricted and Highly Restricted firearms must possess a valid AT permit.
- Restricted and Highly Restricted firearms must be transported unloaded, made inoperable with a secure locking device, and locked in a sturdy container for the duration of the transport.
- Highly Restricted firearms must also have their bolt(s) or bolt-carrier(s) removed, if removable.
SCHEDULE VIII: OFFENCESPossession of a Firearm without Appropriate Permit
- It is a contravention for an individual to possess or use any firearm without a Class I permit, with the exception of use in an appropriate training facility
- It is a contravention for an individual to possess or use a Restricted firearm with only an IU permit, with the exception of use in an appropriate training facility.
Possession of a Highly Restricted Firearm without Appropriate Permit- It is a delict for an individual to possess a Highly Restricted firearm without a CHR-P(-C), CHR-W(-C), or OHR-G permit.
- It is a delict for an individual to possess a Highly Restricted firearm outside of a registered place of residence with only an OHR-G permit.
- It is a contravention for an individual to possess a Highly Restricted firearm on their person outside of their normal working hours with only a CHR-W permit.
Possession of Unregistered Firearms- It is a contravention for an individual to possess an unregistered firearm.
Concealment of Firearms- It is a delict for an individual to conceal firearms on their person without a CHR-P-C or CHR-W-C permit.
- It is a delict for an individual with a CHR-P-C or CHR-W-C permit to conceal a weapon not enumerated on their permit.
Sale of Firearms to Non-Permitted Individuals- It is a contravention for a business or entity to sell, give, or trade an Unrestricted or Restricted firearm to an individual that does not possess the appropriate permit
- It is a delict for a business or entity to sell, give, or trade a Highly Restricted firearm to an individual that does not possess the appropriate permit.
Discharge of Firearms in a Public Place- It is a felony for an individual to discharge a firearm in a public place, except for the purposes of:
Possession of Forbidden Weapons
- approved demonstration;
- hunting within legal areas;
- self-defence; or
- use in the line of duty if the bearer of said firearm is a member of the Commonwealth Armed Forces, Aurentine National Gendarmerie, or any police force or law enforcement body within the Aurentine Commonwealth.
- It is a felony for an individual to possess any weapon defined as forbidden by Article 1, Section C of the Improved Firearms Safety and Licencing Act, unless they meet the exceptions listed in Article 1, Section E and Article 1, Section F of said Act.
- Any weapons found to be related to this offence shall be immediately confiscated and destroyed by the Aurentine Firearms Centre or other appropriate body.
Confiscation of Illegal Firearms- Any individual who is found to have committed a contravention or delict offence under this Act shall submit all firearms related to said offence to the Aurentine Firearms Centre for cataloguing as evidence and further submission to appropriate law enforcement.
- Any individual who is found to have committed a felony offence under this Act shall surrender their permit(s) and all firearms in their possession to the Aurentine Firearms Centre.
- The Aurentine Firearms Centre shall have the right to confiscate and destroy any unregistered or illegally possessed Highly Restricted firearms found during a military, Gendarmerie, or other law enforcement investigation.
SCHEDULE VIII: EXEMPTIONSExemptions for Firearms Permits
- Members of the Commonwealth Armed Forces, Aurentine National Gendarmerie, or any police force or law enforcement body within the Aurentine Commonwealth that are on active duty are exempt from the requirement to possess a firearms license.
Antique Weapons- All black powder muzzle-loading firearms produced before 1898, regardless of type, are exempt from this Act.
- All matchlock, flintlock and wheel lock long guns, regardless of date of manufacture, are exempt from this Act.
Self-Defense- Offences under this Act may be dismissed if a judge determines there was a pressing need for self-defence.
SCHEDULE IX: RIGHTS OF LOCAL GOVERNMENT
- No part of this Act shall be construed as limiting the rights of subnational levels of government (such as cities) from enacting further reasonable restrictions on the use of firearms within their jurisdiction.
- No part of this Act shall be construed as granting the rights of subnational levels of government (such as cities) from to counteract these reasonable restrictions on the use of firearms within their jurisdiction.

Protection of Workers Act

Preamble
An Act of the Senate of Aurentina to make it an offence to assault certain persons in the course of
or by reason of their employment; and for connected purposes.
Section I – Assault of Workers
1. A person, being a member of the public, who assaults a worker ––(a) in the course of that worker’s employment, or
2. No offence is committed —
(b) by reason of that worker’s employment, commits an offence.(a) under subsection (1)(a) unless the person who assaults knows or ought to know that the worker is acting in the course of the worker’s employment,
3. In this section—
(b) under subsection (1)(b) unless the assault is motivated, in whole or in part, by malice towards the worker by reason of the worker’s employment.“worker” means a person whose employment involves dealing with members of the public, to any extent, but only if that employment involves —
(a) being physically present in the same place and at the same time as one or
4. Evidence from a single source is sufficient evidence to establish for the purpose of subsection (1) whether a person is a worker.

(b) (either or both)—(i) interacting with those members of the public for the purposes of the employment, or
“employment” means any paid or unpaid work whether under a contract, apprenticeship, or otherwise.
(ii) providing a service to either particular members of the public or the
public generally,
Section II – Penalties
1. A person guilty of an offence under this Act is liable, on summary conviction, to imprisonment for a period not exceeding 12 months or to a fine of which a Judge may determine upon sentencing.
Section III - Creation of a new Offence
1. From the passing of this Act, a new offence named Assault against the Worker shall hereby be established
2. Assault against the Worker shall be classified as a full criminal offence and as equally enforceable under the law as any offence outlined in the Criminal Code of the Aurentine Commonwealth
3. In any event of a person being charged with this offence, they shall not be subject to any other assault charge already set out in law.
