Affirmative action "positive discrimination" wouldn't be categorically reductive or even terribly arbitrary. Certainly it would be within the intention of the law, which, contrary to ever popular "the law does what the law says", does matter.
In affirmative action--which is employed in deciding who to hire or enroll in a business or school--those who do not receive aid by affirmative action are inherently discriminated against, often on an arbitrary basis.
