[DRAFT] Civilian Explosives Regulation Act

The General Assembly,

Recognizing that explosives at significant explosive velocity can cause physical and psychological harm to civilians in civilian settings if unregulated,

Acknowledging that many nations and cultures allow or mandate that their citizens carry weapons, including various explosives and that their sovereignty in that decision must be respected,

Reaffirming its staunch commitment to the well-being of its member states and peoples within these states,

Hereby:

1. Defines "explosive(s)" as any substance or manufactured substance above 100mg which can cause physical and bodily harm through means of a sudden forceful blast when activated,

2. Defines low, medium, and high damage as 100-500m/s explosive velocity, 501-1000m/s explosive velocity, and 1+km/s explosive velocity respectively,

3. Defines "civilian" as any person or area of persons where there is currently no war or acts of terror being committed,

4. Demands that member states which allow unregulated ownership of explosives (such as a citizen-soldier nation, or war nation) to require that citizens need a state approved permit if owning explosives with high damage,

5. Recommends that member states with pre-existing laws on regulated ownership of explosives to now add a questionnaire to their state census which requires the citizen to declare how many grams of explosives they own if above medium damage if not already in place,

6. Requires member states with unmaintained low to high explosives in public civilian settings be immediately secured and moved to an appropriate state or government facility where the explosive can be properly contained, at a minimum of 10 years after the most recent war, and

7. Mandates that all explosives manufacturers and distributors require government approved licenses for selling explosives to civilians, usually expected to be in the form of fireworks, which may not exceed the medium damage category. Additionally, the buyer must be made aware of the explosive limit which they can purchase. Any transaction between a civilian and manufacturer or distributors without specific state approval will result in a criminal offence punishable by law to both the buyer and the seller. Possible reasons include a popular icon hosting a large party requiring more than low damage explosives, but must be approved by the presiding government.

While this resolution does not impact inter-national relations significantly, it does generally improve the lives of the people within the GA, as most sentient beings enjoy a prolonged life which they do not desire to be cut short by unaccounted explosives. Looking over the draft again, I believe Operative 6 is the most important one, as post-war casualties to unexploded ordinance are still severe and deadly when accidentally triggered. This draft would at least ensure that there aren't any needless deaths in public areas. Perhaps a future resolution can be drafted regarding unexploded ordinance in general (eg former battle sites, rural landscapes, etc. ), but this draft targets populated public settings specifically." Presumably you meant "/s" not "/h" on the last of those?

1. Yup, thanks for catching that mistake.
2. Thanks you! That's what I was wondering about what I had missed. Here's my proposition: Since most fireworks fall under the low damage category, the manufacturer and distributor must have a license of all explosives handled low category and up. Manufacturers and distributors may not sell medium and high damage explosives to civilians, and it is a criminal offence to do so without the government's consent.

The issue crosses no international jurisdictions, involves no damage to international interaction, and does not constitute any particular crime against human rights. If a nation wants to allow their citizens to own hand grenades and anti-tank rockets, and they aren't meeting the criteria for terrorists, why should we prevent them?"

Y'all realize explosive substances are useful for things other than terrorists … right? Tunnels, road building, mining, stump removal, building demolition, a d those are but a few off the top of my head.
Perhaps a little thought before using the wide brush to ban things, eh?

We have objection with the requirement to use a specific from of weight measurement in a citizens total explosive ownership, since other nations may have different measurement systems.

OOC: It's generally presumed -- according to a previous Modly post -- that WA staff ('gnomes') will translate any such measurements used in proposals into equivalent values using appropriate units for each of the various nations, just as they will translate the language for those nations that aren't English-speaking.
