Declaration of Citizens Rights

The Congress of the United States of Philimbesi, assembled this July 7, 2007, in an effort to forever enshrine the rights afforded to all citizens of the nation, its colonies, and territories, do henceforth establish this Declaration of Citizens Rights.

MANDATES that all those, currently living or henceforth born on the soil of the United States, it's colonies or territories are henceforth acknowledged as Citizens of the United States.

MANDATES that those who are not currently living, or born on the soil of the United States may gain citizenship only after clearly announcing their intent, and by completing a course of study in history, culture, and language of the country.

MANDATES that the rights afforded to the Citizens of the United States are extended only to non citizens in the process of gaining citizenship through natural channels.

These rights are as follows.

NO law shall be made prohibiting the free exercise of, or abridging the freedom of speech, or of the press, or the right of people to peaceably assemble and petition the government for a redress of grievances.

NO law shall be made prohibiting the rights of a legal citizen, upon reaching the age of majority, to vote, nor shall any tax or fee be levied on the act of voting.

NO law shall be made that violates a citizens right to be secure in their persons, house, papers, and effects against unreasonable search seizures, and no warrants shall issue except in case where probably cause is affirmed by oath or affirmation and particularly describing the place to be searched and persons or things to be seized.

NO law shall be made that restricts a citizens right to a speedy and public trial, by impartial jury of peers, Nor shall any citizen be held for extended periods of time without benefit of charge, prohibited from confronting witnesses against him or obtaining witnesses in his favor, or prohibited the advice of counsel for their defense.

MANDATES Excessive bail shall not be imposed, nor cruel or unusual punishments inflicted.

MANDATES All Citizens have the right not to be and indeed must not be discriminated against on grounds including sex, race, ethnicity, nationality, skin color, language, economic or cultural background, physical or mental disability or condition, religion or belief system, sexual orientation or sexual identity, or any other arbitrarily assigned and reductive categorization which may be used for the purposes of discrimination, except for compelling practical purposes.

MANDATES Government shall neither endorse, nor condemn any form of organized religion nor shall any public funds be appropriated to support, nor block any religious organization or church endeavor.

FORBIDS The practice of slavery or any other form of forced unpaid labor.

ALLOWS the Government to lay and collect taxes on incomes from whatever sources derived, as long as the amount of that tax not exceed 75% of a citizens yearly income.

The Gun Control Act of 2009

A Resolution: To amend the USP Weapon and Exposives code to restrict firearm sales, possession and usage within the United Sates of Philimbesi, it's colonies, or terrirories.

The Gun Control Act of 2009 hereby:


ESTABLISHES the Firearms Regulatory Commission of The United States of Philimbesi, within the department of Justice.

CHARGES the FRC with developing registration and licensing procedures for all firearms within in the USP.

PROHIBITS the sale to, purchase by, possession or operation of, a firearm by non citizens of the nation.

PROHIBITS the sale to, purchase by, possession or operation of, a firearm by any citizen under the age of majority.

PROHIBITS the sale to, purchase by, possession or operation of, a firearm by any citizen without appropriate licensing.

PROHIBITS the sale, purchase, possession or operation of any fire arm capable of automatic fire

PROHIBITS licensed firearm owners from transferring firearms to unlicensed or non citizens.

PROHIBITS the altering any firearm with regard to identification or ballistic testing.

PROHIBITS any citizen convicted of a felony level crime from obtaining a license to carry a firearm, and any conviction of a felony level crime immediately voids all held licensees.

PROHIBITS the sale, purchase, possession or operation of any fire arm to individuals with a felony criminal record, with a want or warrants issued, or who are under an active restraining order or have been under an active restraining order within one year of application.

MANDATES all ballistic information to be cataloged by the manufacturer and stored in a centralized database maintained by the Firearms Regulatory Commission.

MANDATES the fingerprinting of all individuals issued a firearms license.

MANDATES all merchants selling firearms, to perform criminal background checks, including but not limited to, wants and warrants, and active restraining orders.

MANDATES that said background checks be completed in no less than 3 days and no more then 10 days from application.

MANDATES that any firearm used in the commission of a crime be held by law enforcement until such time its use as evidence is exhausted and then be destroyed.

MANDATES that any licensed firearm that is lost or stolen be reported to law enforcement within 24 hours of the discovery of the loss or theft.

DECLARES citizens who are sworn law enforcement officers and currently serving in the armed forces are EXEMPT from restriction on automatic weapons, during such time they are considered On Duty or Serving.

DECLARES that states have the ability to further restrict the sale, possession, and operation of Firearms.

Drug Purchase and Development Subsidies Act

Be it enacted by the Senate and House of Representatives of the United States of Philimbesi assembled,

An Act

To authorize the allotment of monies to assist USP citizens with paying for pharmaceutical products needed to maintain life, as well as the development costs associated with developing new pharmaceutical products.

DEFINING Pharmaceutical products as any item used directly in life saving actions, or those used to sustain life after injury or disease.
DEFINING Pharmaceutical Production as the methods of creating pharmaceutical products

WHEREAS the founding documents of the USP ensure first and foremost a citizens right to life.

WHEREAS a portion of the population requires pharmaceutical products to sustain life.

WHEREAS the costs of pharmaceutical production continue to rise, therefore the costs of the end products of the production are increasing as well.

WHEREAS no citizen should forfeit their first and foremost right due to the inability to pay for pharmaceutical products.

Article I The DrugSub Program

ESTABLISHES the DrugSub Program

CREATES within the Food And Drug Administration of the Department of
Health, the office of DrugSub Supervisor, reporting to the Food And Drug Administrator.

CHARGES the DrugSub Supervisor with the responsibly of overseeing any and all operations of the DrugSub Program.

ALLOTS a percentage of the Food and Drug Administration budget never exceeding 1% of the total FDA allotment for operation of the DrugSub Office.

ALLOT funds from the Department of Health Budget in the amount of 350,000,000,000, as the DrugSub Subsidy Fund

CHARGES the DrugSub Office, with the dispersal of those funds never exceeding $7500 in one year, to citizens who request them, providing they meet the following criteria.
1. Require daily, monthly, or yearly doses pharmaceutical products to live, or to maintain a reasonable standard of living.
2. Have a gross annual income of less then 25% of the standard GDP
3. Have a gross annual income of more then 25% of the current GDP, but can demonstrate extenuating circumstances.

Article II New Pharmaceutical Development Program

ESTABLISHES the New Pharmaceutical Cure Development Program

ALLOTS monies from the Department of Health fund not exceeding 100,000,000,000 as the New Cure Fund.

REWARDS Pharmaceutical Companies registered in the with the Food and Drug Administration monies not exceeding 10,000,000,000 in the event they produce drugs that cure or make chronic conditions deemed by the Food and Drug
Association as causing the most harm to the Citizens of Philimbesi.

REWARDS Pharmaceutical Companies registered in the with the Food and Drug Administration monies not exceeding 10,000,000,000 in the event they produce drugs that vaccinate non infected people against the conditions deemed by the Food and Drug Association as causing the most harm to the Citizens of Philimbesi

ALLOWS for New Cure Fund monies not used in a fiscal year to be rolled into the next fiscal year.

National Safe Abortion Act

A Resolution: To amend the USP Heath and Safety code to define regulations on the matter of fetal abortion within the United Sates of Philimbesi, it's colonies, or territories.

VALUING the lives of all citizens of Philimbesi.

REGRETTING that at times circumstances arise that cause pregnant citizens to terminate pregnancy prior to delivery.

SEEKING to ensure that this procedure is handled in the safest way possible.

The congress of the United States of Philimbesi hereby :

REQUIRES that any individual seeking a pregnancy termination be granted the procedure in a timely manor.

CHARGES the USP Department of Health with the task of keeping up to date information of doctors currently licensed in the procedure.

CHARGES the USP Department Of Health with the task of continually reviewing current pregnancy termination procedures, and to ensure that information is given to licensed physicians on a regular basis.

FORBIDS any physician not licensed to perform the procedure from doing so.

FORBIDS the disclosure of any information pertaining to the procedure unless order by a court document or by the legally registered parent or guardian when the patient is under the age of consent.

RESTRICTS the procedure of fetal termination via abortion up to the currently accepted age of fetal viability, unless accompanied by a legal order.

REQUIRES that information on alternatives to termination be immediately available upon request and that the patient indicate they were advised of where to find that information.

REQUIRES counseling services are available upon request of the patient.

FORBID any counseling services paid for with state funds to be faith-based in content.

ORDER REQUIRING COMPLIANCE WITH GENERAL ASSEMBLY RESOLUTION #128 OF THE WORLD ASSEMBLY

WHEREAS the World Assembly has seen fit to pass GENERAL ASSEMBLY RESOLUTION # 128 On Abortion.

WHEREAS participation in the WA requires the Philimbesi government to amend existing local law to comply with passed resolutions.

THE PRESIDENT OF THE USP hereby orders:

The Secretary of Heath to review the content of GAR#128

Report to the congress legislative committees any changes that are required in USP Health and Saftey code to bring it into compliance with GAR#128.

The Congress of The United States of Philimbesi, assembled this January 9, 2008. In an effort to ensure that the vestiges of freedom are guaranteed to all inhabitants of the United States, it’s colonies, and territories do hereby enumerate the Rights of the Non Documented

By this Act The United States Congress:

MANDATES that all inhabitants of the United States, it’s territories and colonies who are not considered either documented citizens or in the process of gaining documented citizenship are:.

GRANTED the same rights to free exercise of, of speech, or of the press, or the right of people to peaceably assemble and petition the government for a redress of grievances. .

GRANTED the same rights to freedom from illegal search and seizure,

GRANTED the same rights against excessive bail, and cruel or unusual punishment

GRANTED the same protections against discriminations

GRANTED the same protections against slavery

As normal documented citizens of the United States of Philimbesi.

FURTHER The United States of Philimbesi Congress:

ALLOWS for the voiding of such rights in situations where, after due process it is reveal that the undocumented is in fact partaking in activities that are illegal.

On World Assembly Resolutions

The Congress of the Unified Districts of Philimbesi assembled this 21 of April 2011

SEEKING to ensure the safety and freedom of the citizens of the United States of Philimbesi regardless of the will of the World Assembly.

AFFIRMING that at the time of its entrance into the World Assembly The United States did agree to comply with its ruling.

AFFIRMING that for the most part the rulings of the World Assembly are well intentioned and are in alliance with the diplomatic goals of the United States.

LAMENTING that at times the rulings of the World Assembly can pose a direct threat to the health, safety and freedoms of the citizens of Philimbesi.

CONFIRMING that the overriding purpose of the United States government is,was, and always will be to ensure the safety and well-being of it’s citizenship first.

By this Act the Congress of The United States of Philimbesi,

SECTION #1
1. PERMITS the President of the United States of Philimbesi (POTUSP) to refuse the compliance of any World Assembly resolution passed, in such cases where the Office of the President can demonstrate to the High Court a direct threat to the health, safety, or freedom, of the citizens of the United States.

2. CHARGES POTUSP with informing the Senate of The United States of Philimbesi with his or her intention of refusing compliance and the reasons for recommending such.

3. CHARGES that within one week of receiving notice of the compliance refusal the Senate of The United States of Philimbesi after debate, will denote it's consent or refusal of POTUSP intention. Said consent coming in the form of a 2/3 majority vote, and reported formally by the Senior Senator.

3a. STIPULATES that in the event consent is not received by the Senate the President of The United States of Philimbesi may appeal to the House of Representatives for formal legislation to refuse compliance.

4. CHARGES in the event that consent is received, the intent to refuse compliance will be formally relayed to World Assembly by the office of the USP Ambassador to the USP.

5. ALLOTS a portion of the Department of Justice and State budgets to offset any fines levied by the World Assembly related to non compliance.

Evidentiary Review Act of 2012

An act: To amend the Judiciary Code of the United States of Philimbesi, to provide a central review board for all jury trial verdicts within the United States of Philimbesi, its colonies, and territories.

The Congress of the United States of Philimbesi gathered this day of May 4, 2012:

ESTABLISHES the Evidentiary Review Board of the United States of Philimbesi, within the Department of Justice,

MANDATES the Evidentiary Review Board to consist of 5 citizens who have attained unified magistrate status for their respective districts, selected by the President of United States with the advice of the Philimbesi High Court.

CHARGES the Evidentiary Review Board with the review of all evidentiary and judicial procedure for all level one trials, excepting trials where the verdict is death, to ensure that all evidentiary and judicial procedures were followed.

MANDATES that all verdicts rendered are to be considered final only after the Evidentiary Review Board has completed its review and has reported its findings to the district high court where the trial took place.

MANDATES that until such time as the review is completed for the case the initial court verdict will stand, and any and all retrial or appellate proceedings are permissible.

MANDATES that in the interest of ensuring against the incarceration of innocent citizens ALL guilty verdicts shall be reviewed with priority over acquittals.

On Death Sentances

An Act: To amend the Judicary Code of the United States of Philimbesi, to provide a centralized review of all felony cases to ensure accuracy when the sentence of such a trial is death.

The Congress of the United States of Philimbesi gathered this day of December, 21, 2009

REGRETTING that at times, in an effort to ensure the health and safety of this citizenship of the United States of Philimbesi, it is necessary to put to death a citizen found guilty of a crime.

SEEKING to ensure that this conviction was arrived at by legal and appropriate means, and that punishment of death is in proportion of the crime or crimes the citizen is convicted of.

The Congress of the United States of Philimbesi hereby assembled:

MANDATES a Sentencing Review Counsel be created in all states, made up of nine citizens in good standing, who have obtained the ranking of at least magistrate second class.

CHARGES these counsels with the exhaustive review of all evidence, testimony, and court procedure in any case where the charged received a sentence of death.

MANDATES that should this counsel agree unanimously without reserve or doubt that the sentence was justified by the evidence, testimony and court procedures the death sentence shall be upheld.

MANDATES that should the state council not unanimously without reserve or doubt that the sentence was justified by the evidence, testimony and court procedures the death sentence shall be commuted immediately to 'Life'

DECREES that in cases where the state counsel upholds the verdict, the defense counsel for the convicted citizen may appeal to the High Court of the United States of Philimbesi.

DECREES that should the High Court uphold agree unanimously without reserve or doubt that the sentence was justified by the evidence, testimony and court procedures the death sentence shall be upheld.

MANDATES that should the state council not unanimously without reserve or doubt that the sentence was justified by the evidence, testimony and court procedures the death sentence shall be commuted immediately to 'Life'

DENIES the convicted citizen any parole review in cases where sentences are commuted by the state or High Courts.

DECREES that any review must be completed within seven to ten days of receiving it.
