Corporate Crime In Your Nation

Postby The Multiversal Species Alliance » Tue Dec 25, 2012 7:04 pm

What's the status of corporate crime in your nation? How's it dealt with?
Corporate crime consists solely of charging exorbitant prices on low income people, or harming others in the persuit of profit. If convicted of crime, the CEO and Board of Directors will be executed by firing squad.

Corporate crime is rampant in Elcric Kcalb. That tends to happen when corporations run the government and are mostly allowed to do as they like with little to no fear of repercussions. Sometimes Corporate crime is dealt with, sometimes it isn't. It really depends on how harmful it is to other people.

If an executive was found to do something like that, he would usually be fired before being prosecuted like any other citizen. If it was the company at fault, then usually, consumers switch to competitors, letting the corporation wither on the vine and die unless they renounce their crooked ways and become a law-abiding company.

Corporate crime requires corporations.

It was rampant before the revolution, however.

White collar crime, corporate crime, corruption and the like are the only lawful reasons for the government to intervene with the private sector.

The greatest penalty a corporation as a legal entity can face is the "corporate death penalty". The responsible executives and upper-tier employees are tried for the corporation's sins and can face up to life in prison. The corporation itself also stands trial as a legal person, and if it is, collectively, found guilty of the charges, gets "put to death", in that its operations are suspended, its assets seized, its innocent employees compensated, and the entire liquidable assets are sold on an open market to the highest bidder.
When a corporation as a whole is facing the "death penalty", its responsible parties, such as the CEO or directors, can not be put to death. This actually does more justice than executing those who performed the deed, because corporate death penalties dissolve the legal person and liquidate its assets on the open market.

Crimes include, but are not limited to, price gouging, intentional manufcacture of defectively dangerous goods that directly lead to physical injury or death, lying to inspectors, intentional death of an employee or innocent creature, negligence resulting in injury or death, failure to send employeed youth to their required schooling, embezzling, kickbacks, bribery, money laundering, trafficking or engaging in unlawful material, intentionally causing harm to the poor under its influence, fraud, and other traditional white collar crimes.
An interesting exemption: Regulatory Capture is not a crime.

If a corporation is technically acting lawfully, but its actions or existence is hated... well, that's what captitalism is for. The government doesn't involve itself in corporate crime except when actual crime occurs. Regulatory crap and government invasiveness are done by the Invisible Hand.

Corporations are not treated as a singular entity, they are merely a grouping of employees and their products/services. Each employee is treated as one individual and is recognized as such in a court of law. Corporations do not exists in courts of law, only their board of directors, which are individually identified and charged if criminal activity does take place within the organization.

Although corporations don't exist in our nation, occasionally some state-run institutions that function just like corporations are found to be involved in certain crimes. Those involved are charged with "attempting to disrupt the financial and business stability of the state". They have a whole bucket of acid dropped on their faces, their eyes gouged out, and then sent to either the firing squad or the gas chamber.

Even in a particularly honorable and decent society such as ours, where there are corporations, there will occasionally be corporate crime. Individual perpetrators will usually be fired by employers before facing prosecution by the state. Companies may also collectively be subjected to lawsuits if need be. Usual punishments are various terms of imprisonment and hefty fines.

In times of war, the penalties may stiffen considerably.

Corperations can do a lot of things, but they can't..operate death squads, damage property, kill their workers, make bio/chem weapons, or leave the country/move to another part of the country without giving any workers who can't or won't move a year's pay in compensation.

Insider trading is ok. Price gouging is ok. Even selling many types of drugs and guns is ok.

Most corporate crime falls under the jurisdiction of the Inquisition or the Military Police. It is punished very strictly, including with capital punishment.

Also its not really worth committing. Money is of course useful, but there are many resources that cannot be called by anyone with money, because some resources are in effect reserved for certain types of people based on their achievements on the battlefield or in other endeavors benefiting the nation. It is also difficult to take the money out of the country.

in our non-monetary economy, there is essentially no framework in which for it, in any usual sense, to exist. fraudulent environmental or civil negligence is of course still possible, and of course a serious felony. there just aren't corporations as such to commit it in our economy. the nature of it being what it is.

Virtually all business enterprises in the Imperium are state property, so whatever they do is effectively lawful. Of course, we won't pretend that the managers of these businesses never go corrupt, but the prospect of a lengthy stay in the hospitable premises of a labour camp is enough to keep most of them in line.

Now, while predatory business practices towards fellow Sidhae are strictly forbidden, humans and aliens are all fair game. However, given that most of them belong to enemy nations, and Sidh businesses are state enterprises, the chances of them doing any business with humans or aliens is minimal.

Corporate crime is taken very seriously in Herador, with Heradorians seeing any illegal act at the top of a corporation as directly affecting everyone under that person. As such, corporate crime is punished to the full extent of the law. An example being, two executives ran a Ponzi Scheme at their firm, once Heradorian Officers managed to get a conviction on the two, they received fifty years each.

We dont exactly have what you call corporations. We have some businesses that are pretty large but the vast majority of them are tiny mom and pop style businesses. We make sure to strongly give favoritism to small businesses and have plenty of Anti-Monopoly legislation to prevent any Monopoly and the destruction of Competition.

Any actions threatening the status quo of high amounts of both competition and small businesses they can face sever penalties. Businesses that control more more than 1/1000 of the market in their sector(entertainment, agriculture, mining, etc) will be forcefully broken up into 100 parts, in the name of protecting competition. We allow Businesses to charge whatever the hell they want, we let the market itself be their judge.
