Constitution of the Radiatian Federation

The Radiatian Constitution consists of three documents - the Act of Constitution, the Bill of Rights and the Bill of Responsibility.

THE ACT OF CONSTITUTION:

Preamble:

This Act of Constitution hereby declares the unity of the states of Radiatia, and the agreement to be in Federation.

We are in concordance that all the states, cultures, tribes and peoples, and the representatives thereof are equal and to be as one nation.

We are committed to PROTECT one another, to SERVE our common interests, to grant JUSTICE to our peoples, to DEFEND our individuals’ FREEDOM, to conspire together for the cause of TOLERANCE and to manifest, protect and increase the WELFARE and PROSPERITY of all those who are a part of this Federation .

We stand together as one nation, one federation, strong together and declare to ourselves and the world that RADIATIA shall PREVAIL.

Article I: - Membership

Section One – Definition of Federation
1. The Radiatian Federation refers to all those states who have signed this constitution and agree to its terms.
2. All states that agree to this constitution are to be considered nationals of the Radiatian Federation, and all rights and responsibilities of a Radiatian Citizen are afforded them.
3. States who become members of the Radiatian Federation agree that the laws of the Federation, the Bill of Rights and Bill of Responsibility have precedence over that state’s legislature.
4. States who become members of the Radiatian Federation are committed to the welfare of the Federation and all other states within it
5. States who become members of the Radiatian Federation agree to treat all citizens and peoples of other states as if their own and will not restrict the movement of people from other Radiatian states, unless in situations outlined elsewhere in this constitution or with direct permission from the President of the Radiatian Federation
6. No state may secede from the Federation once they join. Membership is permanent.

Section Two – New States
1. The 43 republics, nations and states who were once members of the Radiatian People’s Socialist Union are invited to become a part of the Radiatian Federation at the signing of this constitution.
2. Should a state wish to join, they must hold a refendum in which two thirds of the people agree to join the Federation. Then the President of the Radiatian Federation must agree and declare that they are a member state.
3. Conquered territories are also welcome to become members of the Federation provided they too have the support of two thirds of their population and permission from the President of the Radiatian Federation
4. For nations and states that were neither conquered nor formerly a part of the RPSU, either geographic, cultural or language ties must be present for them to be granted permission to join the Federation.
5. No new state may be formed within the existing boundaries of a state without permission from the President, the majority of people in that state and a unanimous vote by the Federal Council.

Section Three – Territories
1. Any overseas territory, however small and usually including embassies, military bases and dependencies shall be governed as if a Federal Territory, unless they are granted statehood.
2. Citizens of these territories will be considered citizens of Federal Capital Territory, and not permitted to vote in electoral or state level elections. They may vote for a party in the general parliamentary election.

Article II: - The Legislative Branch

Section One- General
1. Legislative power shall be invested in the Federal Politburo, which shall consist of a President, a Federal Council and a Parliament.
2. Parliament and the Federal Council must sit at least once every 6 months.
3. The Politburo must convene TOGETHER at least once a year, with the Federal Council, The President and Parliament convened in the same room at the same time.
4. The President has the sole power to dissolve Parliament and the Federal Council and call an election
5. Members of the Politburo will be compensated for their work. They will have the base wage stated here, adjusted according to inflation and interest rates in the future
i) The President is to receive a salary of 800,000 Tsenyens per year
ii) The Prime Minister is to receive a salary of 600,000 Tsenyens per year
iii) State Premiers are to receive 400,000 Tsenyens per year
iv) Ministers are to receive 300,000 Tsenyens per year
v) Members of Parliament are to receive 50,000 Tsenyens per year plus expenses

Section Two – Parliament
1. Parliament shall be the largest part of the Politburo, containing 620-621 seats, depending on the nature of overhanging seats.
2. The Members of Parliament shall be elected by the General Public once every four years. All citizens of the Radiatian Federation who are aged 17 years or older are permitted to vote in elections. No state may prohibit any citizen of the Radiatian Federation from voting.
3. The mixed-member proportional representation (MMP) system shall be used.
4. Every state shall have at least one representative in Parliament. States with over 500,000 people shall have one representative for every 500,000 people. This shall make a total of 394 seats. For example at present this will give Alayenia, which has a population of 40 million people 80 seats. Polaris, with less than 500,000 people will have one seat. Pfantz will also only have one seat as although it has more than 500,000 people it still has less than one million.
5. The remaining 226 seats in parliament will be filled by proportional representation of the number of party votes received.
6. The number of seats in parliament may increase or decrease according to population, or if a new state joins. However this will be decided by the President and ratified by the Federal Council, and not by Parliament.
7. The electoral boundaries may change according to population growth and shrinkage. If an electorate has less than 500,000 people (and is not an all-state electorate) then it will disappear. Conversely a state may gain an electorate seat if the population reaches the 500,000 threshold required for one.
8. Should a seat become vacant then the political party of the person who formerly held that seat is permitted to place another party member in their place
9. Parliament is to directly represent the people. While electorate seats will represent those electorates, all of parliament -especially list MPs- are required to be Federal-minded and represent Radiatia as a whole rather than the interests of their own state.
10. Parliament shall choose the Prime Minister and Deputy Prime Minister, who shall in turn appoint people to The Ministry.
11. In order to be able to run for Parliament, one must be:
i) Aged at least 21 years
ii) A citizen of the Radiatian Federation
iii) Resident in the Radiatian Federation for at least 3 years
iv) Have passed a mandatory IQ test with an IQ of above 110
v) Be declared sane
vi) Be in good health
vii) Have no previous criminal convictions
viii) Have declared any potential biases such as ownership of land, corporate or business interests, religious affiliations, etc. to a member of the Supreme Court
12. Parliament shall have sole power of the purse, and power to control the increase and expenditure of revenue and have the sole power to increase or decrease the amount and number of levies, duties and taxes.
13. The President of the Radiatian Federation is to personally act as Speaker of Parliament. However if he is absent or unavailable then he may appoint a member of his staff, typically a member of the military, to act as Speaker on his behalf. As Speaker he may eject unruly MPs and punish MPs for disorderly behaviour, and will set the agenda.
14. Members of Parliament are to be referred to as such, or as MPs. Their official title is MP, which will precede their name. However this title is revoked once they leave parliament, although they may opt for the title of “FMP” for “Former Member of Parliament” which they may keep for the duration of their lifetime.
15. Parliament is required to record all debates and make all records including financial records publicly available at all times
16. Parliament may convene provided that at least one third of MPs are present, however no act shall be passed unless parliament is present in its entirety.
17. All Members of Parliament are required to be present for the final reading of an Act, and for the final vote that will pass it into law and will be summoned as such.
18. Parliament has the power to:
i) Appoint a Prime Minister and select the members of cabinet.
ii) Increase or decrease taxation
iii) Increase or decrease public expenditure and services
iv) Buy and sell state assets
v) Cease funding a particular project
vi) Seize property and nationalise industry
vii) Hold or return property and privatise industry
viii) Enact laws which affect the entire Federation
ix) Set the Federal Standard of Education
x) Fund and equip the Radiatian Federal Army, Navy and Air Force
xi) Control conscription laws
xii) Maintain the armed forces
xiii) Fund military science
xiv) Fund the arts and sciences according to how or if they see fit
xv) Determine the funding level of the Federal Health Service
xvi) Appoint high-ranking military officers and control the internal structure and administration of the RFA
xvii) Control and determine the administrative structure of the FHS
xviii) Enact laws that prevent Radiatians from exploitation
xix) Enact laws that prevent excessive exploitation of the environment
xx) Regulate employment
xxi) Regulate the use of natural resources
xxii) Control monetary policy and appoint the head of the Reserve Bank
xxiii) Control the value of the Tsenyen
xxiv) Control interest rates and inflation rates
xxv) Control the flow of immigration
xxvi) Control what goods are allowed to cross the Radiatian border
xxvii) Charge tariffs on imported goods
xxviii) Exercise authority over the decision of a State government
xxix) Establish interstate highways
xxx) Establish rail infrastructure
xxxi) Establish the Post Office and telecommunications network
xxxii) Establish any state broadcasting companies
xxxiii) Regulate the media
xxxiv) Regulate the use and distribution of arms
xxxv) Regulate and lessen the powers of paramilitaries and state militias
xxxvi) To decide on the punishment for committing a federal crime
xxxvii) To fund and administrate the Radiatian Special Operations Division (R-SOD)
xxxviii) To encourage the flow of information and prevent corruption as much as possible
xxxix) To allow and determine the amount of free speech
xl) To allow the President to borrow money from overseas

Section Three – The Federal Council

1. The Federal Council shall be comprised of one Premier from each state. The Premier shall be the head of that state.
2. The Federal Council are to be elected once every four years, but two years after the General Election and not on the same year.
3. They are to be elected by citizens of the Radiatian Federation who are aged over 21 and have been a resident of said state for one year.
4. The Federal Council is to be elected at the same time as state governments are elected. All states are required to have elections once every four years to determine who will be their head of state.
5. The Head of State of a state is to be referred to as a “Premier.” They must be the head of state and may or may not be the head of that state’s government
6. A Premier may pass state level legislation and be involved in the day to day running of their state, but they are required to sit on the Federal Council and do all duties expected of them for this position.
7. In order to be on the Federal Council, a person must
i) Be aged at least 35 years
ii) Be a citizen of the Radiatian Federation
iii) Be declared sane
iv) Have an IQ above 110
v) Have no obvious business, corporate or religious interests unless they have permission from a member of the Supreme Court and they are within the rules of their political party
vi) Have been a resident of the state for at least 5 years
vii) Have previous experience serving as a member of that state’s government
viii) Have permission from the leader of their political party to run for Premier of that state.
8. Members of the Federal Council are legislators only in terms of their own state governments
9. Should any decision or vote by the Federal Council be tied, then the Prime Minister will be called-upon to make the deciding vote.
10. A former member of the Federal Council shall receive the title “Honourable” for the rest of their lives, even if they are impeached by their state.
11. State governments have the power to impeach their Premier for failure to uphold the state or federal constitution.
12. If a member is impeached, or unable o continue serving, then a new Premier must be elected as soon as possible.
13. A Vice Premier will usually take the place of the former Premier should a replacement not be found and an emergency meeting of the Federal Council held
14. The Federal Council possesses the following powers:
i) The power to try and impeach the President for treason, corruption or failure to uphold the constitution, failure to uphold the oath of neutrality, or for endangering the people of Radiatia
ii) To declare a state of Emergency Absolution and the timeframe of this period which gives the President temporary dictator-like powers
iii) To ratify any constitutional amendments proposed by the President
iv) To hand direct command of the RFA over to the President
v) To hand over the remainder of the nuclear activation codes
vi) To ratify any proposal by the President
vii) To declare war, but only with Presidential support
viii) To ratify a declaration of war by the President
ix) To declare martial law, but only with Presidential support
x) To ratify the President’s declaration of martial law
xi) To slow down the passage of parliamentary legislation, although they are unable to void it
xii) To appoint the President of the Radiatian Federation by unanimous vote
xiii) To appoint members of the Supreme Court, with Presidential support

Section Four – Limits of Powers

1. No law shall be made retroactively. No citizen shall be convicted of an act that was made illegal after they committed it.
2. No law shall contradict the Bill of Rights

Section Five - Powers Prohibited by States

1. No state may pass a law that contradicts the Bill of Rights or any law passed by the Federal Politburo
2. No state may engage in relations with a foreign power or declare hostility against another Radiatian state.
3. No state may declare war against another state or a foreign nation
4. No state shall charge tariffs on goods from another state

Article III – The Executive Branch:

Section One – General
1. Executive Power in the Radiatian Federation is invested in the President
2. There shall be a Federal Cabinet known as “The Ministry”, consisting of a Prime Minister, a Deputy Prime Minister and no fewer than three other portfolios. The total number of portfolios shall be determined at the time by the President however it is up to Parliament to appoint people to these positions.

Section Two – The President
1. The President shall swear an Oath of Neutrality and swear to uphold the Bill of Rights, the Bill of Responsibility and the Constitution with no political bias whatsoever.
2. The President must denounce all previous political biases should he be a former member of government
3. The President must be a citizen of the Radiatian Federation, aged at least 40 years, resident for at least 14 years, deemed sane, in good health, have no corporate, business or religious interests whatsoever and have a mandatory IQ of at least 120. He must be found in good character, a law-abiding upstanding and honourary citizen and deemed so by the Supreme Court.
4. The President shall serve an indefinite term, until he resigns, dies, is impeached or the Supreme Court advises that he is unfit to continue service due to poor physical or mental health (upon which the Federal Council are to impeach him)
5. A President’s title is President, to become Former President for the remainder of his life, even if he was ejected from office in shame.
6. Upon his departure the President may nominate a worthy successor. If the Federal Council vote unanimously in favour of that successor, then that successor becomes the President. If not then the Federal Council must assemble a list of suitable candidates to be elected by Popular Ballot.
7. The President may not accept bribes, threats or commit treasonous acts and if found guilty of doing so by the Supreme Court shall be impeached and sentenced to death.
8. The President has veto power over any parliamentary law and is expected to exercise this in good faith, to ensure that all laws do not contradict the Bill of Rights.
9. The President shall be given an official place of residence within the Federal Capital Territory.
10. The President shall be guarded at all times two high-ranking members of R-SOD and at least four elite members of the RFA.
11. The President shall have access to ALL information, may demand access to any information and is to have unrestricted access to information, intelligence and secret information held by R-SOD and other agencies.
12. After leaving office, the Former President may choose to keep two guards at his discretion
13. The President shall be the Commander in Chief of the Radiatian Military
14. The President shall be given one half of the nuclear activation codes (which are to change every year) with the other half to be divided and held in secrecy by the Federal Council
15. The President shall have the following powers and reserve powers:
i) The power to declare a state of emergency
ii) The power to announce a military alert (Code, Alert and DEFCON)
iii) The power to declare war (with ratification from the Federal Council)
iv) The power to sign foreign treaties
v) The power to dissolve parliament and the federal council and call a general election
vi) The power to dissolve a state government and call an election
vii) The power to directly control the RFA (with ratification from the Federal Council)
viii) The power to launch an atomic strike, provided the Federal Council has given him the remainder of the activation codes
ix) The power to decide which the number and type of portfolios on the Cabinet
x) The power to veto any parliamentary law
xi) The power to veto any state law that contradicts the constitution
xii) The power to propose amendments to the constitution
xiii) To declare martial law, with Federal Council approval
xiv) To appoint members of the Supreme Court, with Federal Council approval
xv) To appoint ambassadors and other civil servants and public officers, upon the advice of the Prime Minister
xvi) The power to remove and impeach Members of Parliament
xvii) The power to act as speaker of the parliament or appoint a temporary one in his absence to act on his behalf
xviii) The power to grant someone the honourary status of “Exalted Citizen” (EC) for great and noble services to the Federation. This title shall be ceremonial only and may be kept for a lifetime.

Section Three – The Ministry (The Cabinet)
1. The Ministry (also known as Cabinet) must at all times consist of one Prime Minister, one Deputy Prime Minister, a Finance Minister, a Defence Minister and a Minister of Law and Order.
2. The President has the power to create other portfolios as he sees fit and is expected to do so.
3. Parliament shall choose who holds which post on the Cabinet.
4. Members of the Cabinet must also be current Members of Parliament
5. The official title of the Prime Minister shall be “Prime Minister”. Upon leaving office they shall receive the title FPM (Former Prime Minister) for the rest of their lives.
6. The official title of the Deputy Prime Minister shall be “Deputy Prime Minister” and should he leave Parliament without obtaining a higher status, such as Prime Minister, then he shall be known for the rest of his life as a “Former Minister”.
7. All ministers’ official titles shall be “Minister” to become “Former Minister” upon their departure from parliament, providing they do not obtain a higher status.
8. Ministers shall be the head of their portfolio and the boss of all public servants employed by their ministry.
9. The Prime Minister shall function as the head of government and the boss of all other ministers
10. The Minister of Defence shall be responsible for the funding and equipping of the RFA, but shall not in any way command, lead or influence the decisions of the army.
11. The Cabinet are expected to be open and accountable to the public, however they do have the right to declare matters a state secret and keep it from Parliament. However such a secret must be released to the public after 25 years and may not be kept from the President or from the Federal Council
12. The Cabinet have the power to execute spending projects, and have control over how and where public money is spent. But they are required to be publicly accountable.
13. Cabinet members spending public money on personal gain (not including salary) shall be impeached and face trial and severe punishment by the Supreme Court.
14. No cabinet member may accept bribes or threats, nor may they favour the will of a foreign power. Doing so shall be punishable by death.
15. Should a cabinet member be impeached, parliament may select a replacement.

Section Four – State of the Federation
1. The President is obliged to at least once per year broadcast through the media a direct message to the public detailing the state of the nation. He may do so as frequently as he wishes but must do so a minimum of once every year.
2. The Prime Minister is also required to deliver a state of the nation address to the general public upon the once yearly recess of parliament, or in exceptional circumstances.

Section Five – Impeachment
1. Any public officer found guilty of accepting bribes, taking bribes, conviction of treason or acting as a result of threat (instead of arresting the person or group threatening them) shall be impeached and sentenced to death, unless the Supreme Court deems there to be mitigating circumstances. In the latter case an official may be spared from the death penalty but shall be permanently banned from holding public office.

Article IV – The Judicial Branch

Section One – Judicial Powers
1. The judicial power of the Radiatian Federation shall be vested in a Supreme Court, and in lower courts.
2. The courts shall follow a heirachy with the Supreme Court as the most powerful, then the Federal High Court, the State High Court, and with District courts at the bottom.
3. Superior courts may overturn a decision by a lower court, however Federal Courts cannot overturn a decision unless it is in breach of the constitution or bill of rights.
4. The Supreme Court shall be responsible for interpreting the constitution and for trying members of the government for breaches of the constitution, treason, or any other illegal and unconstitutional act.
5. All trials shall be by jury, excluding trials to impeach the President in which the decision lies with the Federal Council
6. The Supreme Court may declare mitigating circumstances and decide on a less severe punishment, especially in cases where a crime carries the death penalty.

Section Two – Trials and Jurisdiction

1. All Radiatian courts shall have trials by a jury
2. All courts are expected and encouraged to hold trials as soon as possible
3. The accused are guilty until proven innocent, but the court must not delay a trial longer than one month. If they do then the person must be allowed freedom until they can be tried.
4. No state’s court may overturn the decision made in another state, however the Federal Courts are superior to all.
5. If a person is accused of a crime in one state and manages to escape to another state where the act is not a crime, they shall be extradited to their original state to face trial.

Section Three – Appointing the Supreme Court
1. Members of the Supreme Court shall be appointed for a period of no longer than 20 years by the President, with approval from two-thirds of the Federal Council.
2. In order to stand be on the Supreme Court one must be
i) Aged at least 45 years
ii) Be declared sane
iii) Have an IQ of at least 120
iv) Not have any conflicting business, corporate or religious interests
v) Be of good character without a blemish on reputation
vi) Have obtained the status of a judge
vii) Be qualified as a judge and well-versed in law and constitutional law
3. Members of the Supreme Court may be removed by:
i) Parliament supermajority
ii) Expiration of their term
iii) Reaching the age of 75
iv) Discovery of biases

Section Four – Treason
1. Treason is defined as any act that endangers the Radiatian people without just cause, levies war against them or adheres to their enemies.
2. Accepting bribes is also considered treason.
3. Threatening or harming a member of the government is considered treason.

Article V – The States

Section One – States shall honour each other
1. Each state in the Federation shall honour one another and all are considered equal in terms of authority and validity.
2. No state may interfere in the affairs of another
3. No state may declare war against another
4. All states shall allow freedom of all citizens of all Radiatian states to work, settle and travel there without impair or discrimination and all states shall treat all citizens of the Radiatian Federation equally.
5. States are permitted to have border checks but only for the purpose of tracking wanted criminals, or tracking the movement of immigrants. At no point may a state deny a Radiatian Citizen access to that state.

Section Two – Privileges
1. The citizens of each state are to be considered citizens of the Radiatian Federation and all rights, privileges, immunities and responsibilities that go with that shall be conferred upon them.
2. The Radiatian Federal Government guarantees the protection of all states against invasion or hostility, and against domestic violence or terrorism.

Section Three – Authority
1. All laws passed by a state must not contradict the Act of Constitution, the Bill of Rights or the Bill of Responsibility
2. If there is an inconsistency between state law and Federal law, the latter shall prevail and the former shall be invalid.
3. States are permitted to pass laws that are not otherwise detailed in this constitution.
4. States are permitted to implement a state-wide tax, but only with permission of the Federal Parliament
5. States are permitted to have their own education system, however these education systems are obliged to allow all Radiatians to pass the Federal Standard of Education.
6. States are permitted to keep their own standing armies, for the purposes of policy enforcement (police) and defence. However these State Armies are not permitted to invade another state or foreign nation, nor does the State have the power to command them to do so. The Federal Government have at all times the power to sieze direct command and control of a State Army.
7. The funding of State Armies shall be at the discretion of the Cabinet.
8. States are not permitted to charge duties or tariffs on imports from another state.
9. States are permitted to give a language an official language status, but may not revoke the status of Radiatian as the primary language.

Section Four – Federal Capital Territory
1. Citizens living in the Federal Capital Territory (which shall be defined by the Federal Politburo) are not permitted to be represented on the Federal Council, however they may elect a non-voting representative who, with permission from two-thirds of Parliament, may vote as a tie-breaker in extraordinary circumstances.
2. If the FCT has a population of more than 500,000 they are entitled to have electorate MPs
3. The FCT shall be governed directly by the Federal Parliament

Section Five – Extradition

1. Should a citizen of one state commit a felony and escape to another, the latter state must arrest and send the citizen back to the former state, even if the felony committed is not a felony in the latter state.

Section Six – State Government
1. The Radiatian Federation guarantees that the Premier of every state, who shall serve as the head of that state shall be democratically elected by ballot, with all citizens aged over 17 years entitled to vote.
2. The structure of the state government is up to that state, according to its consitution, provided that it does not contradict this federal constitution or the Bill of Rights.

Article VI – The Radiatian Federation as One Nation

Section One – Language
1. The offical language of the Radiatian Federation shall be the Xerconian dialect of Radiatian.
2. State governments have the power to give their state an official language which shall be in equal but no greater standing than Radiatian
3. All states must educate their citizens to be fluent in the official Radiatian language
4. All states must conduct government and official business in Radiatian
5. All public services must be conducted in Radiatian

Section Two – Education
1. The Federal Standard of Education shall be decided by federal parliament and all education systems must meet these standards. The standard shall include teaching all citizens how to speak Radiatian fluently
2. All schools, universities, polytechnics and educational institutions must conduct lessons in Radiatian, although they are permitted to teach other languages.
3. Provided that all citizens reach the Federal Standard, education shall be a matter decided by the state government

Section Three – FHS
1. There shall be a state-funded Federal Health Service
2. All citizens of all states shall have free and unrestricted access to it, unless minor restrictions are placed upon non-urgent services by parliament.
3. No state government may deny its citizens access to it
4. No state government may set up their own healthcare service, or health law
5. No state government shall interfere in the running of the FHS – this shall be controlled exclusively by the federal parliament.

Section Four – Religion
1. The Radiatian Federation shall not adopt an official religion
2. The Radiatian Federation shall, to an extent, allow freedom to practice religion, provided that such religions do not break laws or attempt to curb or impede on the Bill of Rights
3. No religion or religious organization may influence or attempt to influence the government, although people practising religions are permitted to run for parliament or sit on the federal council with permission from a member of the Supreme Court
4. Any religion that goes against the Bill of Rights, attempts to overthrow the status quo or is found guilty of hate crime shall be banned
5. Anyone practising a religion that cannot be verified scientifically, or can be scientifically proven to false shall be deemed insane and not allowed to run for any public office. However they are still permitted to practice this religion provided none of the stipulations of the above clauses are violated

Section Five – Titles and Nobility
1. All members of government are to be given and are permitted to keep the title given to them according to that which is written in this Act of Constitution
2. The President may give an honourary citizen the lifetime honourary and ceremonial title of “Exalted Citizen” (EC) for their services to the Federation.
3. No actual nobility shall be granted other than a ceremonial title.
4. No land or extra authority shall be given to the receiver of an honourary title

Article VII – Citizenship

1. Any citizen of a state which joins the Radiatian Federation, or who was a citizen or permanent resident of a state at the time of the signing of this constitution shall be granted Radiatian citizenship.
2. Any citizen who is born in any of the states of the Radiatian Federation after the signing of the constitution shall be granted citizenship
3. Following the signing of this constitution, no foreign born person may be granted citizenship at any time, however they may be granted permanent residency.
4. All citizens are granted the rights conferred to them by the Bill of Rights and must carry the responsibilities conferred to them by the Bill of Responsibility
5. A citizen may take dual citizenship and settle in a foreign nation, however if they do their citizenship may be revoked upon request by the Federal Council or Supreme Court.

Article VIII – Amendments

1. The President may propose an amendment to the constitution, however two-thirds of the Federal Council must vote to ratify it
2. An amendment may add to the constitution but not overwrite or remove anything already written here
3. The President may propose amendments to the Bill of Rights and Bill of Responsibility, with the support of the Federal Council, however he shall not remove any pre-existing right or responsibility.
4. The Prime Minister may propose an amendment with a parliament supermajority, however it must be passed by the President and the Federal Council

Article IX – Ratification

The signatures of the Premiers of all states wishing to join the Radiatian Federation, plus the signature of the Prime Minister, Leader of the Opposition, the current elected President and the Founder of the Radiatian Federation shall suffice to establish this Act of Constitution as the founding and binding document of the Radiatian Federation and shall be considered as original law and shall remain unalterable, except by the ways listed above.

RADIATIAN BILL OF RIGHTS

1. All Radiatians have the RIGHT to freedom of information. No idea, fact, or piece of information may be withheld from a Radiatian citizen. State secrets are permitted to be withheld for a period of no longer than 20 years. Radiatians have the right to uncensored internet, television, press, literature and other forms of information dispersal
2. All Radiatians have the RIGHT to education, healthcare, food and housing.
3. All Radiatians have the RIGHT to protection by the state from crime, violence, terrorism and war.
4. All Radiatians have the RIGHT to freedom of movement
5. All Radiatians have the RIGHT to leave and enter Radiatia at any time
6. All Radiatians have the RIGHT to freedom from discrimination
7. All Radiatians have the RIGHT to be treated with preference above an immigrant or foreigner, and the RIGHT to take land or employment from an immigrant in the Radiatian’s favour, provided such an act is necessary and not gratuitous
8. All Radiatians have the RIGHT to learn and speak in any tongue they wish, provided they also speak the primary language of Radiatia
9. All Radiatians have the RIGHT to practice religion privately, or in regulated meetings, as long as these religions are not hateful or discriminatory
10. All Radiatians have the RIGHT to be tolerated and individual
11. All Radiatians have the RIGHT to form their own opinions in private
12. All Radiatians aged over 17 years have the RIGHT to vote in state, local and federal elections for whichever political party or ideology they wish
13. All Radiatians have the RIGHT to peacefully assemble
14. All Radiatians have the RIGHT to peacefully protest in specific areas, and to have a specific area in which they are allowed to protest
15. All Radiatians have the RIGHT to trial by an impartial jury of their peers
16. All Radiatians have the RIGHT to not be tortured or executed while a trial is pending and when they have not yet been found guilty by a trial by their peers
17. All Radiatians have the RIGHT to a quick trial and to be freed from prison if they are incarcerated for 28 days and still receive no trial, however they must still face trial and potential punishment.
18. All Radiatians have the RIGHT to never be used as slaves
19. All Radiatians have the RIGHT to a living wage
20. All Radiatians have the RIGHT to completely free artistic expression which shall not in any way shape or form be censored
21. All Radiatians have the RIGHT to join a political party
22. All Radiatians have the RIGHT to an impartial and unbiased press
23. All Radiatians have the RIGHT to only have their opinions influenced by fact, not by media, or official decree, speculation or coercion

RADIATIAN BILL OF RESPONSIBILITES

1. All Radiatians have the RESPONSIBILITY to defend the federation in times of war, threat or invasion
2. All Radiatians have the RESPONSIBILITY to adhere to the law, as set by state and federal authorities, provided those laws do not contradict the Bill of Rights
3. All Radiatians have the RESPONSIBILITY to pay taxes, as required of them by their elected representatives in parliament
4. All Radiatians have the RESPONSIBILITY to be as well-informed as possible, especially when making choices that affect others such as voting
5. All Radiatians have the RESPONSIBILITY to keep their opinions to themselves
6. All Radiatians have the RESPONSIBILITY to be tolerant of others
7. All Radiatians have the RESPONSIBILITY to look out for the welfare of others and to help those less fortunate than themselves
8. All Radiatians have the RESPONSIBILITY to be as independent and hard-working as they can
9. All Radiatians have the RESPONSIBILITY to do jury duty
10. All Radiatians have the RESPONSBILITY to uphold this Constitution, the Bill of Rights and the Bill of Responsibility

AMENDMENTS:

Amendment One - Increased Size of Parliament
This amendment shall increase the number of seats in the Federal Parliament from 621 to 810 as of the next general election, to recognise and accomodate for the growth in population. 405 of these seats shall be electorate seats, with members elected by pluralty vote in their Federal Electorate, while the remaining 405 seats shall be for list MPS, elected by Proportional Representation of party votes.

Amendment Two - Increased Powers of the Federal Council.
This amendment grants the Federal Council the power to partially void a line of parliamentary legislation before it reaches the President, however this is limited only to legislation that is not realted to financial or monetary policy, or involving the budget which power shall remain squarely in the hands of parliament.
This power shall be added to the list of powers outlined in the Act of Constitution Article II, Section Three, Clause 7.

Amendment Three - Citizens May Initiate Referendums
This amendment stipulates that should any branch of government be presented with a petition requesting the holding of a referendum, and should that petition be signed by 1% of the population of Radiatia, then the government is bound to hold the requested referendum.

Amendment Four - Referendums Are Binding
The amendment gives the people of Radiatia, through power of a referendum whether initated by the citizens or initiated by the state, the power to override any governmental decision. All referendums are now binding, and no government may ignore a referendum result, the penalty for doing so to be impeachment or more severe punishment.
